O� <br />�� <br />the city that works for you <br />Report Number <br />Agenda Section <br />Council Meeting Date <br />REQUEST FOR COUNCIL CONSIDERATION <br />14 -241 <br />VI -5 <br />September 23, 2014 <br />ITEM DESCRIPTION: Subdivision Agreement between the City of New Brighton and AN Group <br />LLC. <br />DEPARTMENT HEAD'S APPROVAL: <br />CITY MANAGER'S APPROVAL: <br />No comments to supplement this re <br />Comments attached <br />Recommendation: Authorize the Mayor44d City Manager to enter into a Subdivision Agreement <br />between the City of New Brighton and APi Group Headquarters, LLC, agreement of which is subject to <br />the final approval by the City's redevelopment counsel. <br />Legislative History: On January 14, 2014 the City and AN have entered into a Contract for Private <br />Redevelopment. The Redevelopment Agreement requires that the AN enter into this Subdivision <br />Agreement. On July 22, 2014, the City Council passed Resolution No. 14 -063 approving the Minor <br />Subdivision of Lot 1, Block 3, Long Lake Landing and Resolution No. 14 -064 conditionally approving <br />the Site Plan for development of a 1.94 acre parcel with a 3 story, 45,000 SF training center and office <br />building within the New Brighton Exchange Redevelopment Area located at the northwest corner of <br />Northwest Parkway and Old Highway 8 NW. <br />Financial Impact: AN will be responsible for the design and construction of the improvements shown <br />on the Site Plan. The City will cost share in certain New Brighton Exchange related development <br />improvements for enhanced pedestrian and aesthetic improvements located in the adjacent public right <br />of ways as set forth in the Site Plan. Specifically, the City will pay APi $7,500 to install decorative <br />concrete pavers, and the City will be responsible for the installation and associated costs to install two <br />limestone pylons at the SW corner of the subject property. <br />Explanation: Staff has been in discussions with AN Group since mid -2012 on an office expansion <br />project in New Brighton Exchange. APi met with the Council in December 2012 and shared their plans <br />to build up to 75,000 square feet of office space in two different buildings. The parties formalized the <br />basic business terms this past spring and eventually a term sheet was approved by the City Council on <br />June 11, 2013. APi is proposing to build a 45,000 square foot building on the south half of the site. <br />They have an option to build a second building of up to 30,000 square feet on the north half of the site. <br />The attached Subdivision Agreement is for the south half of the redevelopment of the property. The <br />Subdivision Agreement governs such things as public improvements, private improvements, timing, <br />permitting, workmanship, warranties and sureties, survey controls, erosion control, street sweeping and <br />other site development issues. <br />Costs and Funding: Any costs paid to AN shall be from NBE Tax Increment District. <br />Grant M.
