5. As specified in Section 8-130 of the New Brighton Zoning Ordinance,no special <br /> use shall be recommended by the Planning Commission unless such shall find: <br /> a. That the establishment,maintenance,or operations of the special use will not <br /> be detrimental to or endanger the public health, safety,morals, comfort of <br /> general public. <br /> b. That the special use will not be injurious to the use and enjoyment of other <br /> property in the immediate vicinity for the purposes already permitted,nor <br /> substantially diminish and impair property values within the neighborhood. <br /> c. That the establishment of the special use will not impede the normal and <br /> orderly development and improvement of the surrounding property for uses <br /> permitted in the district. <br /> d. That adequate utilities,access roads, drainage and/or necessary facilities have <br /> been or are being provided. <br /> e. That the special use shall, in all other respects,conform to the applicable <br /> regulations of the district in which it is located. <br /> 6. The Planning Commission held a public hearing,reviewed the project and found the above <br /> criteria to be satisfied and recommended approval to the City Council. <br /> 7. The City Council finds the special use permit criteria are met. <br /> N DW THEREFORE BE IT RESOLVED, that based upon the above findings of fact the application for a <br /> Special Use Permit and Site Plan Review SP05-10&LP05-06 is hereby approved with <br /> the following conditions: <br /> 1. Approval of a permit by the Rice Creek Watershed District. <br /> 2. The storm sewer pipe is relocated at the applicant's expense at a location to be <br /> approved by the City Engineer. <br /> 3. An easement is granted and filed for municipal access to the storm sewer line. <br /> 4. The applicant shall redraft the landscape plan to be approved by the City Planner. <br /> 5. Sidewalk connection is made to the sidewalk on the west side of Old Highway 8. <br /> 6. A redrafted site plan is submitted showing the front entrance to be approved by the <br /> City Planner. <br /> Adopted this 26th day of April,2005. <br /> Steve Larson, Mayor <br /> A.
