RESOLUTION No.07-119 <br /> STATE OF MINNESOTA <br /> COUNTY OF RAMSEY <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND APPROVING OF AN AMENDMENT TO SITE PLAN <br /> LP200 5-001 DOCUMENTED UNDER RESOLUTION#06-029. <br /> WHEREAS, an application has been made by FW Gordon Construction to be considered for an <br /> amendment to a previously approved Site Plan, which revises the materials proposed for the <br /> exterior of the building at 1820 Old Highway 8 NW,known as the Rush Lake office building. <br /> WHEREAS,the procedural history of the application is as follows: <br /> 1. Tie City Council approved LP2005-006 on April 26,2005. <br /> 2. Tie City Council approved LP2006-001 on March 28,2006. <br /> 3. Ac,application for a Site Plan Amendment was received on November 2,2007. <br /> 4. Tne Planning Commission provided a recommendation of the proposal on November 20, <br /> 2037. <br /> 5. The City Council considered the request on November 27,2007. <br /> WHEREAS,the Planning Commission and City Council make the following Findings of Fact with <br /> respect to the amended Site Plan(LP2007-012): <br /> 1. The Site Plan was previously approved in Resolution 06-029 and outlines development of the <br /> site in compliance with the MX district standards. <br /> 2. Resolution 06-029 reflects the re-approval of the Site Plan and Special Use Permit originally <br /> approved and documented under Resolution 05-036. <br /> 3. The revised building elevations are consistent with the General Performance standards noted <br /> in Section 6-390. <br /> 4. The revised building elevations are consistent with the MX district performance standards of <br /> Section 6-570 (2), provided the applicant breaks up the western façade with a secondary <br /> 1"h.ilding material. <br /> 5. The exterior cornice element must remain, although it can consist of a material that imitates <br /> stone,and must wrap around the entire building between the 2"d and 3rd floors. <br /> 6. The amended Site Plan does not impact any other zoning requirements as to building height, <br /> setbacks,floor area ratios,parking,etc. <br /> 7. The proposed revision does not impact any of the conditions noted in Resolution 06-029. <br /> Now THEREFORE BE IT RESOLVED,that based upon the above findings of fact the application for <br /> a Silo Plan Amendment (LP2007-012) is hereby approved in accordance with attached Exhibit <br /> A,abject to the following condition: <br /> 1.
