Not Approved <br /> PLANNING COMMISSION PROCEEDINGS <br /> Regular Meeting—July 17,2012 7:00 p.m. <br /> Present: Chairperson Bruce Howard, Commissioners Steve Danger,Erin Nichols-Matkaiti,Mike Shardlow,Greg <br /> Meyers,Paul Banker, and Verne McPherson <br /> Absent:None <br /> Also Present:Janice Gundlach-City Planner, Grant Wyffels-Public Works Director,Gina Bauman-Councilmember <br /> Agenda Review: There were no changes to the agenda. <br /> Minutes: Minutes from June 19,2012 were presented and approved. <br /> Council Action: Councilmember Bauman reported the Council actions taken at their meeting on July 1 Oth. She noted a <br /> work session was held and the Council discussed airing public comments. It was explained the Phase I Flood Mitigation <br /> at Freedom Park was approved by the Council. The project would be funded by an inter-fund loan. <br /> Public Hearing: <br /> (A) Citizens State Bank requests an amendment to the Special Use Permit for 1820 Old Highway 8 NW, <br /> amending the previous approval to allow the 4th floor to be converted to an office use,whereas the <br /> previous approval provided for a residential use. <br /> City Planner Janice Gundlach reported the applicant is requesting an amendment to the previously approved Special Use <br /> Permit for 1820 Old Highway 8 NW. The previously approved special use permit allowed construction of a mixed use <br /> building and a fourth floor when normally only three floors are allowed. The mixed use provision allowed office uses on <br /> the first through third floors and two residential units on the fourth floor. The special use permit amendment would be to <br /> convert the fourth floor from a residential use to an office use. <br /> City Planner Janice Gundlach explained this property has never been occupied since its initial construction,which began <br /> in 2006. The property has also changed hands numerous times and been in foreclosure. The applicant applied for permits <br /> to finish the shell of the building and all exterior improvements in late 2010,which carried over into 2011. It is staff's <br /> understanding the intent of the shell fmish was to attract a buyer. The applicant has been working with a broker,but no <br /> buyer has ever materialized. At one point in 2011,Volunteers of America had approached the City on a residential <br /> reentry facility. That proposal was not consistent with the Zoning Code and the applicant ultimately withdrew their <br /> request. With this request,the applicant hopes to make the building more attractive to an office user,which is likely the <br /> most reasonable use of the property as currently finished. <br /> City Planner Janice Gundlach indicated this property has an extensive approval history dating back to 2005. Three <br /> resolutions are on file representing an original approval in 2005 (05-036), a re-approval of the originally expired approval <br /> in 2006 (06-029), and an amendment related to exterior materials in 2007 (07-119). Staff recommends approval of the <br /> amendment to the Special Use Permit, subject to the following conditions: <br /> • Continued compliance with Resolutions 05-036, 06-029, and 07-119. <br /> Commissioner Danger questioned if the 77 parking stalls was adequate to meet the needs of the entire site. City Planner <br /> Janice Gundlach clarified that based on the net square footage of the building,the 77 parking stalls met the City's parking <br /> requirements. <br /> Motion by Commissioner Banker,seconded by Commissioner McPherson to close the Public Hearing. <br /> Approved 7-0. <br /> 1 <br />
