PLANNING REPORT <br /> DATE: November 16, 2012 <br /> CASE: Z02012-002, SP2012-005 <br /> SUBJECT: Zoning Code Special Circumstance and Special Use Permit concerning <br /> on-site parking and permanent signage at the Community Center, 400 l Ot <br /> ST NW <br /> APPLICANT: New Brighton Parks & Recreation Department and Silver Tower Subs, <br /> Inc. —Daniel O'Bresky <br /> REQUEST&BACKGROUND <br /> New Brighton Parks & Recreation staff has been in discussions for several months with Daniel <br /> O'Breksy (franchisee) regarding a new Subway shop to be located in the New Brighton <br /> Community Center (NBCC). While the City is the landlord and the lease will be dealt with <br /> separately, for zoning purposes the Parks & Recreation Department and Mr. O'Bresky are acting <br /> as co-applicants for this request. The New Brighton Community Center is somewhat of a unique <br /> facility because it includes a variety of public/private activities that each has their own demands, <br /> especially related to parking. The introduction of a fast food restaurant-type use that relies (in <br /> part) on existing NBCC patrons creates an unusual situation for a standard land use review— in <br /> some ways it falls into what is referred to as "special circumstance" under Chapter 11 (Parking <br /> Standards) of the Zoning Code. This section of the code addresses things like proof of parking, <br /> ride sharing, other uses (not specifically mentioned) and joint facilities. <br /> In this case, the applicants are requesting consideration of the "other uses" category of Sec. 11- <br /> 040 (4). This subsection allows the City to consider unique circumstances when evaluating the <br /> required amount of parking. Additional information is provided later in the memo. This request <br /> does not require a public hearing. <br /> The applicants are also requesting an amendment to the existing Civic Campus Comprehensive <br /> Sign Plan concerning allowed permanent ground signage at the New Brighton Community <br /> Center. The New Brighton Parks & Recreation Department has prepared an amendment to the <br /> Sign Plan that would allow logos on ground signs, which isn't something that is presently <br /> allowed. Any amendment to the Civic Campus Comprehensive Sign Plan requires a Special Use <br /> Permit, which triggers a public hearing and notification of neighbors within 350' of the property. <br /> The Community Center is zoned B-4, Downtown Business, and commercial uses (including <br /> restaurants) are permitted in this zoning district.
