" <br /> (3) That the establishment of the special use will not impede the normal and orderly <br /> development and improvement of the surrounding property for uses permitted in the <br /> district. <br /> The general area is fully developed, however approximately %Z mile south of the property <br /> is approximately 100 acres of property in the process of being redeveloped. There is a <br /> possibility redevelopment of that property could be impacted if the proposed reentry <br /> center were located so close in proximity. While staff is unsure of the exact impact, a <br /> apartment developer currently constructing a building has expressed some concern over <br /> the proposed use being located too close and at a northern gateway area to City. <br /> (4) That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br /> being provided. <br /> The proposed reentry center would be accommodated by existing utilities, access roads, <br /> and drainage. It should be noted that the existing site at 1820 Old Highway 8 NW was <br /> developed contemplating approximately 15,000 SF of office space. This resulted in built <br /> parking way in excess of what the applicant would need. This suggests a under-use of the <br /> property, in an area demanding high intensity. <br /> (5) That the special use shall in all other respects conform to the applicable regulations of the <br /> district in which it is located. <br /> All regulations related to the building/site construction are met. <br /> To conclude, staff finds that most of the permitted use determination criteria of Section 8-063 are <br /> not met. Additionally, an examination of the special use standards suggest the proposed use may <br /> cause some detriment to the general health, safety and welfare as outlined in the above analysis. <br /> STAFF RECOMMENDATION <br /> Hold the public hearing and accept testimony. <br /> Make a separate recommendation for each request. Staff recommends the following: <br /> 1. Recommend the appeal of the staff level decision that the proposed residential re-entry <br /> center does not qualify as a special use is denied. <br /> 2. Recommend the proposed residential reentry center is not allowed as a permitted use <br /> based on an inability to meet the permitted use determination criteria of Zoning Code <br /> Section 8-063 and the special use criteria of Section 8-130. <br /> Direct staff to prepare denial findings of fact for consideration at the August 16, 2011 Planning <br /> Commission meeting, supporting the information presented in the written staff report and the <br /> testimony given during the hearing. <br /> dUUiL 8144IaA"- <br /> Janice Gundlach, City Planner <br />
