RESOLUTION <br /> PLANNING COMMISSION <br /> CITY OF NEW BRIGHTON <br /> RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING DENIAL OF A ZONING CODE <br /> AMENDMENT REQUEST. <br /> WHEREAS, an application has been made by Tim Larson on behalf of Dairy Queen at 409 Old <br /> Highway 8 NW to amend the Zoning Code to allow manual changeable copy signs when the <br /> current Zoning Code prohibits them per Section 9-040 (1) (F), and <br /> WHEREAS,the procedural history of the application is as follows: <br /> 1. An application for a Zoning Code Amendment was received on September 1, 2011. <br /> 2. The Planning Commission, pursuant to published notice, held a public hearing on September <br /> 20, 2011 and all present were given a chance to freely speak at the hearing. <br /> 3. The Planning Commission voted to recommend denial on September 20, 2011. <br /> WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the <br /> requested Zoning Code Amendment (ZA2011-003): <br /> 1. The property is zoned I-1, Light Industrial. <br /> 2. The property is guided in the Comprehensive Plan for BP, Business Park. <br /> 3. The applicant has proposed an amendment to Chapter 9 of the Zoning Code that would allow <br /> manual changeable copy signs, also known as reader boards. <br /> 4. Zoning Code Section 9-040 (1) (F) currently prohibits manual changeable copy signs <br /> throughout the entire City. <br /> 5. The Planning Commission considered the following factors in making a recommendation to <br /> deny the request: <br /> a. Manual changeable copy signs have been prohibited in the city for at least the last 34 <br /> years. <br /> b. The prohibition of manual changeable copy signs is due to aesthetic concerns such as <br /> letters falling off, discoloring of the face, and the other maintenance concerns that exist <br /> for manual changeable copy signs that do not otherwise exist for other signs. <br /> c. With recognition of the financial impacts, there is electronic reader board sign technology <br /> available that allows a business owner to achieve the same goals as a manual changeable <br /> reader board sign without the aesthetic concerns. <br /> NOW THEREFORE BE IT RESOLVED, that based upon the above findings of fact the application <br /> for an amendment to the Zoning Code to allow manual changeable copy signs is hereby <br /> recommended to the City Council for denial. <br /> I:\COMMISSIONS\PLANNING\Reports\2011\9-20-2011\ZA2011-003(Tim Larson for DQ)-RESOLUTION(denial).doc 1 <br />
