September 23 , 2014 <br />District. Report No. 14-244. <br />City Manager Lotter indicated Senior Engineering Supervisor Schlichting would be presenting this <br />item to the Council. <br />Senior Engineering Supervisor Schlichting stated the purpose of this item was to hold a public <br />hearing to present the Feasibility Study for City Project 13-20, Innsbruck Pond Taxation <br />District. The history of this request was reviewed in detail with the Council. It was noted staff <br />has met with residents of Innsbruck Pond. Following this meeting, staff is recommending that <br />the City hire a pond maintenance company to chemically treat Innsbruck Pond for weeds; and <br />create a storm sewer improvement taxing district of the 33 lots as indicated by the City Council <br />on May 27,2014, to pay for the cost. He explained this taxing district would be similar to the <br />storm sewer taxing district that was set up for Lake Diane and Bicentennial Pond. Staff <br />indicated the pond maintenance project and storm sewer taxing district is proposed to be <br />established beginning in the year 2015, with one chemical treatment ofthe pond per year. The <br />cost for the pond improvements were reviewed with the Council. He stated that after <br />surveying the pond, muck and other residual material would have to be removed from the pond <br />through a City initiated project. <br />Public Works Directory Wyffels explained that 33 homes were recommended to be included in <br />the special taxing district. He recommended the Council hold a Public Hearing and adopt an <br />Ordinance that would establish a Storm Sewer improvement tax district for Innsbruck Pond; <br />and adopt a Resolution ordering project 13-20, Innsbruck Pond Taxation District as proposed <br />in the Feasibility Study. <br />Councilmember Jacobsen asked how the residents around the pond reacted to staffs <br />recommendation. Senior Engineering Supervisor Schlichting reported staffs recommendation <br />was based on the feedback received at the last meeting with the residents. He noted there was <br />opposition to the installation of a fountain. In addition, some homeowners opposed being <br />included in the process. <br />Councilmember Burg feared that the expense to establish the taxing district was too high, and <br />believed the homeowners may wish to treat the pond themselves. <br />Mayor Jacobsen asked if this taxing district was unique. Senior Engineering Supervisor <br />Schlichting commented this district was unique as it was within a City park. He reported that <br />the City was still offering to pay 25% of the expense to treat the pond. City Manager Lotter <br />reported the adjacent residents are seeking aesthetic amenities for the pond and this triggered <br />the taxing district request. <br />Councilmember Jacobsen asked how the pond was chemically treated this year. Senior <br />Engineering Supervisor Schlichting reported the neighbors came together and solicited funds <br />to cover the $400 expense for the chemical treatment. <br />Councilmember Bauman believed the taxing district had become too expansive. She asked if <br />dredging of this pond would be assessed to the surrounding property owners. Senior <br />Engineering Supervisor Schlichting explained the expense to dredge the pond would not be <br />assessed to the surrounding homeowners but rather would be an expense assumed by the City. <br />He anticipated that the pond would be dredged in 2015 when the trail project was completed. <br />Councilmember Bauman recommended the taxing district be reconsidered in 2015 after the <br />trail project and dredging was complete. <br />Motion by Councilmember Burg, seconded by Councilmember Bauman to open the <br />Public Hearing. <br />5 Ayes, 0 Nays -Motion Carried <br />The Public Hearing was opened at 8:01 p.m. <br />Page 5 of 10 <br />Taxation District and <br />Consideration of <br />Proposed <br />Improvement Project <br />13-20, Innsbruck Pond <br />Taxation District. <br />Report No. 14-244.
