<br />~ <br /> <br />" <br />i: <br />II <br />,i <br />;1 <br />!i <br /> <br />, <br />.. <br />\ <br />I <br />, <br /> <br />RESOLUTION No. 98-049 <br />CITY OF NEW BRIGHTON <br /> <br />RESOL~JTION MAKING FINDINGS OF FACT AND APPROVAL OF NC-11 O. <br /> <br />~EREAS, an application for a nonconforming use permit has been made by Howard Hermann. <br /> <br />V()-IEREAS, the procedural history of the application for a nonconforming use permit is as follows: <br />\! 1. An application for a nonconforming use permit was filed with the City of New Brighton <br />on March 25, 1998. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on April 21, 1998, and all persons present at the hearing were given an <br />opportunity to be heard. <br />'! 3. On April 28, 1998, the City Council considered NC-l10. <br /> <br />~w, THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect <br />to NC~ ~ 10: <br /> <br />1. <br />j;' 2. <br /> <br />;i <br /> <br />3. <br /> <br />The subject site is zoned B-3, General Business. <br />The following Type IV nonconformities exist on the subject site (500 Old Highway 8): <br />a. The existing setbacks for the parking area and drive aisles do not meet the required <br />thirty (30) foot setback. <br />b. The number of drive entrances to the site exceeds the maximum requirement of one <br />(1) per street frontage. <br />c. The drive aisle widths do not meet the minimum requirement of twenty-four (24) feet <br />for two-way traffic. <br />d. There is no perimeter curbing around the parking lot and drive aisles. <br />e. The off-street parking area is not paved with bituminous surface as required by Code. <br />f. The off-street parking area is not striped as required by Code. <br />The applicant is proposing the following to address the non-conforming uses: <br />a. Increase the drive aisle widths from eighteen (18) feet to twenty-two (22) feet. <br />b. Pave the entire site. <br />The applicant is not proposing to reduce the nonconformities to the furthest extent <br />possible. <br /> <br />4. <br /> <br />BJt IT FURTHER RESOLVED, the application NC-110 is hereby recommended for approval subject to <br />the fol~pwing conditions: <br /> <br />U i Perimeter curbing be installed per the attached "revised site plan". <br />2;: All off-street parking and drive areas be paved with bituminous surface. <br />3;: Off-street parking stalls must be striped. <br />4;1 Landscaping/green area be provided as shown on the "revised site plan". <br /> <br />~ <br />
