<br />.~ <br /> <br />.., <br /> <br />RESOLUTION No. 98-033 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />WHEREAS, The 1991 Minnesota Legislature establ ished a Ramsey County local <br />Government Services Study Commission to "report on the advantages and disadvantages of sharing, <br />cooperating, restructuring, or consolidating..." activities in the areas of public service including <br />public works; and <br /> <br />WHEREAS, The consolidation plan provides for reclassification of roadways and <br />corresponding changes in jurisdiction including the transfer of local and State Aid roadways between <br />the County and municipalities; and <br /> <br />WHEREAS, Stowe Avenue (County Road 163) from Cleveland Avenue to New Brighton <br />Road, located in the City of New Brighton, is presently under the jurisdiction of Ramsey County as a <br />County Road; and <br /> <br />WHEREAS, This roadway segment has been determined to serve a local function only; <br /> <br />and <br /> <br />WHEREAS, Revocation of "County Road" status may be accomplished by resolution of <br />the Ramsey County Board of Commissioners pursuant to Minnesota Statutes 9163.11; and <br /> <br />WHEREAS, The City of New Brighton has concurred that jurisdiction should be changed <br />from Ramsey County to the City of New Brighton, and <br /> <br />WHEREAS, The consolidation plan stipulates that Ramsey County shall improve the <br />roadways to acceptable levels prior to transferring jurisdiction over roadway segments from Ramsey <br />County to municipalities, and the Ramsey County Capital Improvement Program provides funding <br />for these improvements; and <br /> <br />WHEREAS, The City of New Brighton desires to reconstruct this segment of Stowe <br />A venue for an estimated cost of $131 ,107 and fund the reconstruction project with Municipal State <br />Aid Street sources, and an estimated $50,000 from Capital Improvement Funds from Ramsey County <br />Roadway Consolidation; and <br /> <br />WHEREAS, The County and the City will enter into a winter maintenance agreement <br />allowing the County to continue to perform snow and ice control operations for this segment of <br />Stowe Avenue and to be reimbursed for those operations by the City of New Brighton; Now, <br />THEREFORE, BE IT <br /> <br />RESOLVED, That the revocation of Stowe A venue will be effective the date of the award <br />of the reconstruction contract, and after the Ramsey County Office of Budgeting & Accounting has <br />encumbered the funds necessary to reimburse the City and the County is in receipt of an adopted <br />resolution from the City concurring with the County revoking the "County Road" status of Stowe <br />Avenue; and BE IT FURTHER <br /> <br />Page 1 of2 <br /> <br />, l <br /> <br />I <br />r <br />I <br />I <br />I <br />
