In accordance with Section 26-31 (9) the preliminary plat shall remain in effect for a <br />period of 12 months from the date of Council approval. <br /> <br />NOW THEREFORE BE IT RESOLVED that based upon the above findings of fact the application for <br />a Preliminary Plat (PL2015-001) is hereby recommended for approval, in accordance with <br />attached Exhibit A, subject to the following conditions: <br /> <br />1. The applicant shall file for final plat approval within 12 months of the date of Council <br />approval of the preliminary plat. <br />2. At the time of final plat submittal the applicant shall pay park dedication fees for three <br />newly created lots, amounting to $5,160. <br />3. Prior to final plat approval the applicant shall remove the encroachments on lot 1, block 2 <br />including two sheds and a fence. <br />4. Incorporation of the comments contained within the Interoffice Engineering/Public Works <br />Memo dated 2-11-2015. <br />5. Prior to final plat approval the applicant shall remove the encroachments on lot 1, block 1 <br />which include the driveway located on the west side of the lot. <br />6. Prior to final plat approval the applicant shall remove the existing home located at 1333 12th <br />Ave. NW. <br />7. A permit from the Rice Creek Watershed District shall be submitted in conjunction with a <br />building permit for proposed lot 1 block 1, and for lots 1, 2 and 3 on block 2. <br /> <br />BE IT FURTHER RESOLVED, that based upon the above findings of fact the applications for <br />Preliminary Plat is hereby recommended to the City Council for approval. <br /> <br />Adopted this 17th day of February, 2015. <br /> <br /> <br /> <br /> <br /> <br /> <br />ATTEST: <br /> Bruce Howard, Planning Commission Chair <br /> <br /> <br /> Janice Gundlach, City Planner <br />
