MnDOT Contract No: 07080 <br /> <br /> -3- <br /> <br />Receivable Lump Sum (Municipal Agreements) <br />3.2. Bridge No. 62890 Lighting. Maintenance and ownership of any lighting facilities construction. <br />Maintenance of electrical lighting systems includes everything within the system, from the point of <br />attachment to the power source or utility, to the last light on the feed point, including but not limited to re- <br />lamping of lighting units or replacing of LED luminaires, repair or replacement of all damaged luminaire <br />glassware, loose connections, luminaires when damaged or when ballasts fail, photoelectric control on <br />luminaires, defective starter boards or drivers, damaged fuse holders, blown fuses, knocked down poles <br />including wiring within the poles, damaged poles, pullboxes, underground wire, damaged foundations, <br />equipment pad, installation of approved splices or replacement of wires, repair or extending of conduit, <br />lighting cabinet maintenance including photoelectric cell, electrical distribution system, Gopher State One <br />Call (GSOC) locates and painting of poles and other equipment. New Brighton will be responsible for the <br />hook up cost and application to secure an adequate power supply to the service pad or pole and will pay all <br />monthly electrical service expenses necessary to operate the lighting facility. <br />3.3. Additional Drainage. None of the parties to this Agreement will drain any additional drainage volume into <br />the storm sewer facilities constructed under the construction contract that was not included in the drainage <br />for which the storm sewer facilities were designed, without first obtaining written permission to do so from <br />the other party. The drainage areas served by the storm sewer facilities constructed under the construction <br />contract are shown in a drainage area map, EXHIBIT "Drainage Area", which is on file in the office of the <br />State's District Hydraulics Unit at Roseville and is incorporated into this Agreement by reference. <br />4. City of New Brighton and Arden Hills Bridge No. 62890 over Trunk Highway 35W Responsibilities. <br />A. Multi-Color surface finish; when the aesthetic multi-color surface treatment needs repainting, the State <br />will coordinate with the Parties to repaint the surface on a reimbursable basis, if the Parties elect not to <br />participate in the cost of a multi-color finish, the State will repaint the surface with a standard color <br />finish. <br />B. Ornamental Rail or Structural Tubular Rail; when the aesthetic ornament rail or structural rail needs <br />repair, the State will coordinate with the Parties to repair the rail on a reimbursable basis, if the Parties <br />elect not to participate in the cost of the repair, the State will replace the rail with a standard rail. <br />C. The State is responsible for inspection and structural maintenance of Bridge No. 62890, concrete bridge <br />approach panels, concrete surfacing, abutments and non-ornamental railings. <br />4.2. Future Responsibilities. Upon completion of the County Road F and Bridge No. 62890 (10th Street N.W. <br />and Valentine Lake Road) construction, the Parties will accept full and total responsibility of their respected <br />roadways and all obligations and liabilities arising out of or by reason of the use, operation, maintenance, <br />repair and reconstruction of County Road F up to Bridge No. 62890 approach panels (10th Street N.W. and <br />Valentine Lake Road) and all of the facilities constructed as part of this Agreement, without cost or expense <br />to the State. <br />5. City of Arden Hills Maintenance and Responsibilities. <br />5.1. Future Major Pond Maintenance. The State will provide maintenance of the Mustangs Infiltration Basin at <br />the time major maintenance is necessary. The City of Arden Hills will share in the costs of major <br />maintenance based on a contributing flow percentage of 22%. The City of Arden Hills will be invoiced <br />accordingly. <br />5.2. Storm Sewers. Routine maintenance of any storm sewer facilities construction outside of T.H. 35W <br />mainline. Routine maintenance includes, but is not limited to, removal of sediment, debris, vegetation and <br />ice from structures, grates and pipes; repair of minor erosion problems; minor structure repair; and any other <br />maintenance activities necessary to preserve the facilities and to prevent conditions such as flooding, <br />erosion, sedimentation or accelerated deterioration of the facilities. <br />5.3. Additional Drainage. None of the parties to this Agreement will drain any additional drainage volume into <br />the storm sewer facilities constructed under the construction contract that was not included in the drainage
