Director of Community Assets & <br />Development/Planning Director <br /> <br />SUBJECT: Follow-Up – February 24th Urban Farming Work Session Discussion <br /> <br />Based on the discussion that occurred at the February 24th work session, staff offers the <br />following additional information: <br /> <br /> The draft ordinance has been revised to reflect the Council’s direction that <br />language be included requiring fowl to be restrained. <br /> The lot size and maximum fowl chart (Sec. 6-201) has been revised based on the <br />discussion that occurred at the last work session. <br /> An analysis of single family lots in New Brighton reveals the following: <br /> <br />10,000 SF or less – 630 properties, 12.6% <br />10,001 SF – 20,000 SF – 3,988 properties, 78.5% <br />20,001 SF – 45,000 SF – 360 properties, 7.1% <br />Over 45,000 SF – 94 properties, 1.9% <br /> <br /> Based on discussion at the last work session, it seemed like the Council may also <br />want to consider establishing a maximum coop size. The Urban Farming Task <br />Force recommended only a minimum based on assumptions that most residents <br />wouldn’t want to obtain a building permit for a coop and the maximum size <br />structure that could be built without a building permit is 120 SF. Since that time, <br />the State adopted an updated Building Code in January that increases the <br />maximum structure size without a building permit to 200 SF (10’ x 20’ structure). <br /> There was some discussion regarding runs. The Urban Farming Task Force felt <br />specific requirements for runs weren’t necessary if there was language included in <br />an ordinance that fowl “be restrained”. The Task Force felt this allowed the <br />resident to best determine how to exercise their fowl. <br /> The draft ordinance specifies that coops be located in the back/rear yard and meet <br />existing 5’ side and rear yard setback requirements.
