Noise <br />The applicant maintains noise impacts will not change. This is likely the case with the <br />majority of the noise attributed to the dumping of rubble, which his regulated by the <br />sound barrier (earthen berm and wall). The applicant’s narrative indicates the sound <br />barrier will remain intact and no increases in audible noise to the residential <br />neighborhood to the west should be felt. Staff cautions that noise attributed to rail car <br />storage and traffic increases are not fully known. No formal recommendations related to <br />noise are proposed by staff. <br /> <br />STAFF RECOMMENDATION <br />Staff recommends approval of the Zoning Code Amendment, Special Use Permit, and <br />Site Plan based on the following conditions: <br />1) The expansion shall be consistent with the submitted Site Plan, except that the 100’ x <br />100’ salt storage shed is removed. <br />2) An annual inspection on or within 30 days of July 15th shall be required to ensure <br />compliance with the Environmental Constraint Overlay Area conditions. <br />3) Allowed pile storage shall be based upon 30% of the area noted for pile storage on the <br />Pile & Equipment Storage Map (attached to this memo). This equates to 30% of an <br />11 acre pile storage area, or 8 acres of pile storage allowance. <br />4) Rail cars shall not be stored on the 1000’ rail siding for more than 110 days per <br />calendar year and materials stored within the cars shall be limited to black dirt, <br />bituminous, concrete, and other processed aggregates associated within the aggregate <br />crushing/recycling and associated materials storage and excavation (Belair <br />Excavating) uses at 2200 Old Highway 8 NW. The applicant shall keep a log of days, <br />including loading and unloading times, which shall be made available for review <br />during the annual inspection. <br />5) The Ordinance does not include the [bracketed-shaded] language proposed by the <br />applicant. <br />6) The approximate 130’ x 656’ segment of expansion property within the ECOA <br />extending west from Old Highway 8 NW to the applicant’s proposed 8’ vegetated <br />berm (at the east end of the “Belair Construction Equipment & Supply Storage” area) <br />shall be preserved in its current condition to provide an adequate buffer between Old <br />Highway 8 NW and the pile and equipment storage areas. <br />7) The berm located at the east boundary of the “Belair Construction Equipment & <br />Supply Storage” area depicted on the Site Plan shall be at least 8’ in height and be <br />vegetated (not constructed of rubble). <br />8) The applicant enters into an Encroachment Agreement concerning the storm sewer <br />that runs across a portion of their property. <br /> <br />Staff recommends denial of the following: <br />1) Inclusion of the Road Salt Storage and Transfer Facility use within the ECOA. <br />2) Regulating pile storage based on 30% of the total land area, resulting in 11 acres of <br />pile storage. <br />
