3. Incorporation of the comments contained within the Interoffice Engineering/Public Works memo dated February 11, <br />2015. <br />4. Prior to final plat approval the applicant shall remove the encroachments on lot 1, block 2 including two sheds and a <br />fence. <br />5. Prior to final plat approval the applicant shall remove the encroachments on lot 1, block 1 which include the driveway <br />located on the west side of the lot. <br />6. Prior to final plat approval the applicant shall remove the existing home located at 1333 12t" Ave. NW. <br />7. A permit from the Rice Creek Watershed District shall be submitted in conjunction with a building permit for proposed <br />lot 1 block 1, and for lots 1, 2 and 3 on block 2. <br />Commissioner Nichols - Matkaiti requested further information on the new home locations. Planning Director Gundlach <br />reviewed the proposed locations for the new homes based on the City's current setbacks. <br />Tom Semanski, 1208 13th Street NW, he questioned how many new homes were being proposed. Planning Director <br />Gundlach explained that five lots were being created and a net increase of three new homes would be constructed. <br />Rodney Waldoch, 1220 NW 13t11 Street, stated he lived adjacent to proposed subdivision. He requested that he be able to <br />remain using this driveway as is even after the proposed in platted into new lots. He commented that he and his dad <br />would continue to maintain the fence and buildings if the adjacent property owner would give them a deeded easement. <br />Mr. Semanski asked where the pond water would drain. Planning Director Gundlach reviewed the drainage plans and <br />commented the water would drain into a 4" outlet pipe. <br />Commissioner Deick asked if the existing easement was temporary or permanent. Marty Campion, project engineer, <br />stated he has not found an easement on the ECK property. He stated he was still trying to obtain a copy of an easement on <br />*he adjacent property. Planning Director Gundlach explained that if any easement was recorded it would be against the <br />Naldoch and adjacent Mazzenga properties. <br />Commissioner Nichols - Matkaiti asked if the encroachment would impact the pond plans. Mr. Campion stated the grading <br />and pond outlet may be slightly impacted. <br />Chairperson Howard noted that staff was recommending approval of the request with conditions. One of the conditions <br />for approval was for the applicant to resolve the encroachment issues. <br />Motion by Commissioner Nichols - Matkaiti, seconded by Commissioner Deick to close the Public Hearing. <br />Approved 5 -0. <br />Motion by Commissioner Erickson, seconded by Commissioner Deick, to approve staff recommendation. <br />Commissioner Deick suggested the word "resolve" replace the word "remove" within Conditions #4 and #5. The <br />Commission supported this friendly amendment. <br />Approved 5 -0. <br />Helicopter Demonstration: Friday, February 20'h at 10:00 am <br />Planning Director Gundlach stated APi was exploring the option of installing a helipad on their site. For this reason, the <br />company was offering a demonstration on Friday, February 201h at 10:00 a.m. in order to understand the noise and setback <br />impacts. She reviewed the location of the demonstration in St. Paul and encouraged the Planning Commissioners to <br />Mend the demonstration. <br />
