<br />~' <br /> <br />1'1 <br /> <br />! c <br /> <br />RESOLUTION No. 98-102 <br />CITY OF NEW BRIGHTON <br /> <br />R;:SOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF NCp 112. <br /> <br />WHEREAS, an application for a nonconforming use permit has been made by Minar Ford. <br /> <br />WHEREAS, the procedural history of the application for a nonconforming use permit is as <br />follows: <br />1. An application for a nonconforming use permit was filed with the City of New <br />Brighton on October 2, 1998. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on October 20, 1998, and all persons present at the hearing were given an <br />opportunity to be heard. <br />3. On October 20, 1998, the Planning Commission unanimously recommended approval <br />ofNC-112. (Vote: 7-0) <br /> <br />Now, THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to NC-l12: <br /> <br />1. The subject site is zoned B-3, General Business. <br />2. The following Type IV nonconfonnities exist on the subject site: The existing <br />setbacks for the parking area and drive aisles do not meet the required thirty (30) foot <br />setback. <br />3. The green space setback from the curb along Service Drive is fifty (50) feet, and there <br />is a 4 foot retaining wall screening the parking area on 27th Avenue from adjacent <br />property to the west. Therefore, an expansion of the parking area and drive aisle <br />setback is not necessary. <br /> <br />BE IT FURTHER RESOLVED, the application NC-112 is hereby approved subject to the following <br />~nditions: <br /> <br />1. All off Street parking stalls required for customer, employee, service bays and <br />building square footage (378 total spaces) must be single depth, marked with white or <br />yellow painted lines not less than four (4) inches wide. <br />2. Adequate number of on-site parking stalls shall be maintained for customers and <br />employees. <br />3. Seven (7) off-street stalls must be designated for handicap parking. <br />4. Wall signage shall be installed per the proposed elevation plans dated 10-7-98: There <br />shall be one "Ford Oval" on each of the west, south and east walls above the main <br />entrance~ and one "Minar Ford" sign on both the south and west walls. No wall <br />signage is allowed on the west and north sides of the building, including the second <br />story addition. <br /> <br />i i <br />
