" Council Member Ho f f ma n introduced the following resolution, the reading of which was dispensed with by unanimous consent, and moved its adoption: CITY OF NEW BRIGHTON COUNTY OF RAMSEY ST A TE OF MINNESOTA RESOLUTION NO. 98-100 A RESOLUTION APPROVING SPECIAL LEGISLATION. BE IT RESOLVED by the City Council (the "Council") of the City of New Brighton, Minnesota (the "City"), as follows: WHEREAS, Laws of Minnesota 1998, Chapter 389, Article 11, Section 24 (the "Special Law") was enacted by the Legislature of the State of Minnesota and signed into law by Governor Arne Carlson on April 21, 1998, and relates to special rules governing the use of tax increment financing by the City within a designated area of the City; WHEREAS, Subdivision 3 of the Special Law provides that the Special Law is effective upon approval by the governing bodies of the City and Ramsey County (the "County") and that the City comply with Minnesota Statutes, Section 645.021, Subdivision 3; WHEREAS, Minnesota Statutes, Section 645.021, Subdivision. 3 provides that upon approval of the Special Law by the City and the County, the City must file with the Secretary of State a certificate of approval, as proscribed by the Attorney General, along with a copy of its resolution of approval prior to the first day of the next regular session of the Legislature. WHEREAS, the first day of the next regular session of the Legislature is Tuesday, January 5, 1999. NOW, THEREFORE, BE IT RESOLVED by the Council of the City as follows: 1. The Special Law is hereby approved. 2. The Clerk-Treasurer is hereby directed to file a certificate of approval and a certified copy ofthe City's resolution of approval with the Secretary of State. 1
