<br />\~~ <br /> <br />'" <br /> <br />~~ <br /> <br />RESOLUTION No. 98 -096 <br />CITY OF NEW BRIGHTON <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />.' <br /> <br />RESOLUTION APPROVING SUBDIVISION OF CERTAIN PROPERTY WITHIN THE CITY OF NEW BRIGHTON <br />(2700 RICE CREEK ROAD - RICE CREEK SHOPPING CENTER). <br /> <br />WHEREAS, the City of New Brighton has been requested to subdivide certain property in the <br />City of New Brighton, legally described as follows: <br /> <br />Lot 2, Block 1, Rice Creek Plaza <br /> <br />WHEREAS, the City Council, pursuant to published and mailed notices, held a public hearing on <br />October 13, 1998, and all persons present at the hearing were given an opportunity to be heard. <br /> <br />WHEREAS, State Statutes require that if such property is located in municipalities that have <br />adopted a platting ordinance, approval of the municipality must be obtained before such subdivisions <br />can be filed; and <br /> <br />WHEREAS, Section 26-24 of the New Brighton City Code provides for subdivision of property <br />without platting if certain criteria can be met. In the case of a request to divide one lot into no more <br />than two lots, and the newly created property line will not cause the other remaining portion of the lot to <br />, be in violation with this chapter or the zoning ordinance, the division may be approved by the council <br />after submission of a survey by a registered land surveyor showing the original lot and the proposed <br />division; and <br /> <br />WHEREAS, the proposed subdivision meets the criteria in Section 26-24 of the New Brighton <br />City Code, regarding a two lot subdivision; and <br /> <br />NOW THEREFORE BE IT RESOLVED, the City Council of the City of New Brighton <br />approves the subdivision of the above-described property into parcels legally described as follows: <br /> <br />Tract A, Block 1, Rice Creek Plaza <br />& <br />Tract B, Block 1, Rice Creek Plaza <br /> <br />G:ICDI-9B-CCIRESOIPL"248.WPD <br />
