New Brighton Shoreland Overlay Ordinance <br />Chapter 12 <br />ORDINARY The boundary of public waters and wetlands, and shall be an elevation delineating <br />HIGH WATER the highest water level which has been maintained for a sufficient period of time to <br />LEVEL (OHWL) leave evidence upon the landscape, commonly that point where the natural <br />vegetation changes from predominantly aquatic to predominantly terrestrial. For <br />watercourses, the ordinary high water level is the elevation of the top of the bank of <br />the channel. <br />RECREATIONAL Generally medium-sized lakes of varying depths and shapes with a variety of <br />DEVELOPMENT landform, soil, and groundwater situations on the lands around them. They often <br />LAKES are characterized by moderate levels of recreational use and existing development. <br />Development consists mainly of seasonal and year-round residences and <br />recreationally -oriented commercial uses. Many of these lakes have capacities for <br />accommodating additional development and use. <br />SETBACK The minimum horizontal distance from a building, structure, fence, or parking lot <br />to a lot line or Ordinary High Water Level. <br />SHORE IMPACT All land between the water's edge and a line parallel to it at a setback of 50 percent <br />ZONE of the structure setback, as detailed below. <br />SHORELAND Land located within 1,000 feet from the normal high water level of a lake, pond, or <br />flowage and land within 300 feet of a river or stream. <br />STEEP SLOPE Lands having average slopes over 12 percent, as measured over horizontal <br />distances of 50 feet or more that are not bluffs. <br />Article 4. Administration & Permits <br />Section 12-310 Permits Required <br />1) When a building permit is required for any activity regulated herein, no additional <br />shoreland alteration permit shall be required. However, the standards for the activity as <br />contained herein shall be applied to the issuance of that permit. <br />2) A shoreland alteration permit shall be required for all construction and development <br />activity regulated within this Chapter including for: <br />A. The placement or construction of structures located closer to the OHWL than the <br />setbacks indicated for principal and accessory buildings in in 5.05, Subd. 2 <br />(unless a building permit is required and issued) <br />B.
