Utilities, access roads, and drainage will not be negatively impacted and existing facilities <br />will support the proposed helipad. <br />5) That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br />The original site was approved via a Planning Unit Development. Being the helipad isn't a <br />building, much of the existing regulations do not apply. With the limited use proposed and <br />the overall landscaping plan, staff finds the proposed setbacks of 23' from Northwest <br />Parkway and 90' from Old Highway 8 NW to be sufficient. The proposed improvements do <br />involve a net loss of two parking stalls. The stalls that are impacted are due to a pathway <br />proposed between the headquarters building and the helipad. Because the parking lot was <br />designed and built to support the existing headquarters as well as the 9, 000 SF building that <br />was never built, a loss of two parking stalls does not have any significant impacts on <br />available parking, especially considering the helipad will not generate a demand for more <br />parking stalls. <br />All other regulations have been examined through the special use permit criteria. <br />Based on the above analysis, staff finds the standards of Section 8-130 are met, subject to <br />conditions. Staff also suggests the public testimony from nearby residents should assist the <br />Planning Commission and City Council in determining compliance with the standards of Section <br />8-130 and whether or not the conditions proposed on the use are sufficient in terms of mitigating <br />overall impacts related to wind, noise and dust. <br />STAFF RECOMMENDATION <br />Hold the public hearing and accept public testimony. <br />Staff recommends adoption of draft Ordinance 835. <br />Staff recommends approval of the Special Use Permit, as requested and subject to the following <br />conditions: <br />1) City Council adoption of proposed Ordinance 835. <br />2) The helipad continuously complies with the provisions of Zoning Code Section 6-693(C). <br />Any deviation from these conditions will constitute non-compliance with the Special Use <br />Permit. <br />3) In an effort to confirm compliance with Section 6-693(C), item 5, the applicant shall furnish <br />flight logs to City staff on a yearly basis, on or within 30 days of January 30tH <br />4) Allowed landings shall be for personal use of the property owner only and shall not be used <br />by a third party, except in emergency situations. <br />5) Applicant submits to the City copies of secured FAA and MnDOT permits for the helipad. <br />6) The flight paths shall consist only as provided in Exhibit I of this report. <br />7) Helicopter noise associated with the helipad shall not exceed the following decibel levels <br />measured at ground level: <br />a. A maximum of 93 dB within a 250' radius of the helipad and a 12 hour average decibel <br />level of no more than 86 dB. <br />b. A maximum of 91 dB within a 250' — 375' radius of the helipad and a 12 hour average <br />decibel level of no more than 78 dB. <br />
