RESOLUTION <br />PLANNING COMMISSION <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A SPECIAL USE <br />PERMIT. <br />WHEREAS, an application has been made by APi Group, Inc to permit construction and use of a <br />50' x 50' helipad, including associated landscaping, sidewalk, and lighting improvements at <br />property located at 1150 Old Highway 8 NW, and <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was received on May 27, 2015. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on June 16, 2015 and all present were given a chance to freely speak at the hearing. <br />3. The Planning Commission recommended approval, subject to conditions, on June 16, 2015. <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the <br />Special Use Permit (SP2015-006): <br />1. The property is zoned NB, New Brighton Exchange. <br />2. The property is guided in the Comprehensive Plan for City Center. <br />3. The property is legally described as follows: <br />Lot 1, Block 2, LONG LAKE LANDING, Ramsey County, Minnesota. <br />4. The applicant has proposed to construct and use a 50' x 50' helipad 20 times per calendar <br />year. <br />5. The applicant has made application for a Zoning Code Amendment, providing a legislative <br />means to make land use application for a helipad. <br />6. The Zoning Code Amendment proposed would permit helipads by special use permit, as an <br />accessory use to building types B 1 and B2 of the New Brighton Exchange zoning district. <br />7. Proposed Ordinance 835 is also being considered for approval simultaneously. <br />8. Zoning Code Sections 6-693(c) and 8-130 have been examined within the Planning Report <br />dated June 12, 2015. <br />9. The Planning Commission reviewed the proposal in accordance with the following proposed <br />special use conditions of draft Ordinance 835: <br />a. The helipad must be accessory to the office use. <br />b. Permitted only on properties containing all of the following attributes: <br />c. At least four (4) acres in area or the principal use has been permitted via a Planned <br />Development, <br />d. Abutting Interstates 694 or 35W. <br />e.
