SHORELAND ORDINANCE — City of New Brighton <br />PLAY EQUIPMENT <br />Potential issues to consider for regulating <br />Flooding obstruction or floating hazard <br />o Larger items that become detached from the ground and float sometimes become <br />hazardous to other structures during flooding. <br />o Anchoring would lessen chance of damage but also prohibit them to be removed from <br />the flood area seasonally or as needed. <br />Visual obstruction <br />o Visual impact could be limited by the maximum size (height and footprint) <br />What other communities are doing <br />Regulation of "play apparatus" appears rare. <br />South St. Paul and Bloomington do have a provision that play apparatus over 4 feet in height is <br />not allowed in the front yard and must be setback 5 ft. from side and rear lot lines. <br />Defining more specifically what items are being regulated (or are exempt from regulations) <br />separately from buildings/structures and fences is one suggestion. Neither of the ordinances <br />containing these definitions actually regulates them in the shoreland. <br />o Ancillary Uses: Uses that are subordinate to the principal and accessory uses on the <br />property including but not limited to recreational structures, fire pits, laundry -drying <br />equipment and play equipment. (Shoreview) <br />o Recreation, residential: Play apparatus such as swing sets and slides, sandboxes, poles <br />for nets, picnic tables, lawn chairs, barbecue stands, and similar equipment or <br />structures, when used on residential property, but not including electronic towers, tree <br />houses, swimming pools, playhouses exceeding twenty-five (25) square feet of floor <br />area, or sheds utilized for storage of equipment.
