New Brighton Shoreland Overlay Ordinance <br />Chapter 12 <br />4 <br />May 14th 2015 <br />3) Activity regulated under Section 5.08 “Shoreland Vegetation Alterations” and other <br />activities specifically exempt listed within this Chapter shall not require a shoreland <br />alteration permit. <br /> <br />Section 12-320 DNR Notification Procedures <br />1) Notification shall be provided to the DNR Area Hydrologist at least 10 days prior to a <br />public hearing to consider variances, SUPs or Plats within the shoreland area or <br />amendments to the shoreland standards <br />2) Notification shall occur 10 days after a final decision on all variances, SUP’s or <br />subdivisions <br /> <br />Article 5. Development Standards <br /> <br />Section 12-410 Lot area and width standards shall be regulated per the underlying zoning district <br />of the property <br /> <br />Section 12-420 The use of all properties within the shoreland area shall be regulated per the <br />underlying zoning district. <br /> <br />Section 12-430 Height of structures and other facilities on lots shall be regulated per the <br />underlying zoning district of the property except for where specified herein. <br /> <br />Section 12-440 Impervious surface coverage shall be limited to 50% of any lot or parcel. <br /> <br />Section 12-450 Setback Requirements <br />1) Where structures exist on the adjoining lots, structure setbacks may be altered allowing <br />them closer to the water’s edge without a variance to conform to the adjoining setbacks <br />from the ordinary high water level. The distance shall be determined by the average <br />setback of structures on the two immediately adjoining lots and shall be allowed only <br />provided the proposed structure is not located in a shore impact zone. <br />2) Along with the setback requirements in the underlying zoning district, the following <br />setback requirements from the Ordinary High Water Level (OHWL) shall apply to all <br />principal & accessory buildings which do not meet the provisions of Section 5.05 item <br />number 1 (above) <br /> <br /> <br /> <br />Water Body Setback <br />Jones Lake 50 feet <br />Long Lake 50 feet <br />Pike Lake 50 feet <br />Poplar Lake 50 feet <br />Rush Lake 150 feet <br />Rice Creek 50 feet
