<br />II <br />Ii <br /> <br />RESOLUTION NO. 97-082 <br /> <br />i <br />J <br />1 <br />I <br />I <br />I <br />I <br />I <br /> <br />.....' <br /> <br />CITY OF NEW BRIGHTON <br /> <br />I, RESOLUTION MAKINO FINDINGS OF FACT AND APPROVING SP-203. <br /> <br />;; <br />i ~ <br /> <br />WHEREAS, an application for a special use permit has been made by the Salem Baptist Church to construct a 23,890 <br />square foot addition. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a special use permit was filed with the City of New Brighton on October 31,1997. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing on November 18, <br />1997, and all persons present at the hearing were given an opportunity to be heard. <br />3. On November 25,1997, the City Council considered SP-203. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect to SP.203: <br /> <br />1. The subject site is zoned R-l, Single Family Residential <br />2. The applicant is proposing to construct a 23,890 square foot addition. <br />3. Churches and similar uses are a special use in the R-l district. <br />4. The proposed addition would include classroom and gym facilities. The proposed addition would also include <br />potential day care facilities. The proposed classroom facilities would be used for regularly scheduled religious <br />education classes, youth meetings and activities. Sunday school classes would meet Sundays 9:40-10:40 am. <br />Youth groups would meet Sunday and Wednesday evenings. The applicant also intends to use the classrooms for <br />twelve step recovery programs, support groups and adult education classes. The applicant anticipates that the <br />gym facilities would be in use every night of the week for youth and adult activities. <br />5. Parking demands for worship services will be on Sunday and Wednesday. Parking demand for the proposed <br />classroom facilities will be primarily on weekdays and weekday evenings. The activities, as proposed, will not <br />create parking conflict and place excessive demand on the proposed parking facilities. <br />6. The City of New Brighton (the City) may grant a special use permit for such a use within the R.l district only if <br />the use meets the standards specified in Section 8-130 of the New Brighton Zoning Code, which standards <br />follow: <br />a. That the establishment, maintenance, or operations of the special use will not be detrimental to or <br />endanger the public health, safety, morals, comfort of general welfare; <br />b. That the special use will not be injurious to the use and enjoyment of other property in the immediate <br />vicinity for the purposes already permitted, nor substantially diminish and impair property values within <br />the neighborhood; <br />c. That the establishment of the special use will not impede the normal and orderly development and <br />improvement of the surrounding property for uses permitted in the district; <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have been or are being provided; <br />e. That the special use shall, in all other respects, conform to the applicable regulations of the district in <br />which it located. <br /> <br />BE IT FURTHER RESOLVED, the application SP-203 is hereby approved subject to the following conditions. <br /> <br />1. <br /> <br />Conformance and adherence to all standards for special use permits as pertains in Section 8-110 and 8-130 of the <br />City of New Brighton Zoning Ordinance. <br />Approval of and continuing compliance with LP-335 and VN-3l6. <br />The applicant shall be required to obtain a special use permit prior to operating a parochial school or licensed <br />day care in the subject church. <br /> <br />2. <br />3. <br /> <br />Adopted this 25th day of November, 1997. <br /> <br />~ <br />.
