Ms. Janice Gundlach <br />October 30, 2015 <br />Pap -c 2 <br />McCoy anticipates hiring up to 10 new employees for Truck Country. Any required painting on <br />Truck Country inventory will occur offsite. The majority of the operations on the Property will <br />be screened from both the adjacent Interstate 35W ("I -35W") and Fifth Avenue SW by a uniform <br />row of Truck Country inventory and various shrubs and bushes as shown in the landscaping plan. <br />Discussion <br />Special Use Permit <br />Consistent with City Code Section 8-130, the following findings necessary to grant the SUP for <br />the proposed truck sales are satisfied: <br />a. The establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general <br />welfare. <br />The addition of the proposed truck sales operation is consistent with the current use of the <br />Property for truck and equipment repair in an area of the City zoned for that purpose. Given its <br />location in an established industrial area and separated by I -35W from the nearest residential <br />uses, the proposed operation will not endanger public health, safety, morals comfort or general <br />welfare of residents. The Property will be enhanced with several improvements, including <br />landscaping, a fenced and gated perimeter for security purposes, various building improvements, <br />and resurfacing of the parking area as necessary (the "Improvements"). These Improvements <br />will increase security, reduce off-site impacts and contribute to improved public health and <br />safety. <br />b. The special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially <br />diminish and impair property values within the neighborhood. <br />The proposed use of the Property will not be injurious to the use and enjoyment of property in <br />the vicinity and will contribute to improved property values within the area. The Improvements <br />represent a significant investment in the Property resulting in both improved safety and <br />aesthetics. The operations of Truck Country will present a more orderly and clean appearance in <br />comparison to the industrial character of the existing operations. Truck Country's inventory and <br />the proposed landscaping will effectively screen the Property from traffic on the interstate. <br />C. The establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding propertyfor uses permitted in <br />the district. <br />The establishment of truck sales on the Property will not impede the normal and orderly <br />development and improvement of surrounding properties. All properties in the vicinity, <br />including the Property, are zoned I-2 Heavy Industrial District. This District allows for a range <br />of heavy industrial uses. The proposed use will not restrict the use or development of any of the <br />surrounding properties for uses permitted in the District. <br />
