RESOLUTION NO. <br />15-081 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION AUTHORIZING ACQUISITION BY EMINENT DOMAIN AND APPROVING APPRAISED VALUES <br />FOR CITY PROJECT 16-1, 2016 STREET REHABILITATION. <br />WHEREAS, the City Council deemed it necessary and expedient that the City of New Brighton <br />("City") construct certain public improvements, to -wit: City Project 16-1, 2016 Street <br />Rehabilitation Project ("Project"); and, <br />WHEREAS, the City Council authorized preparation of a feasibility report for the Project, and the <br />City Council has received and approved the feasibility report; and, <br />WHEREAS, by Resolution No. 15-051, the City Council ordered the Project and instructed the City <br />Engineer to proceed with the preparation of plans and specifications; and, <br />WHEREAS, the Project includes among other things: the reconstruction of County Road E2 from <br />5th Avenue NW to the Bridge at I -35W; improvements to the storm water management system, <br />including the installation of a storm water holding pond; and, reconstruction of the intersection <br />of County Road E2 and 5th Avenue NW; and, <br />WHEREAS, it is necessary to acquire certain permanent easements and temporary construction <br />easements (collectively "Real Property Interests") depicted in Exhibit A attached hereto in order <br />to install and maintain the Project; and, <br />WHEREAS, the City Council finds that it is reasonably necessary, proper, and convenient, and in <br />the interest of the general welfare that the City acquire title to and possession of the Real <br />Property Interests in furtherance of Project; and, <br />WHEREAS, the City Council finds that the construction schedule for the Project makes it necessary <br />to acquire title to and possession of the Real Property Interests prior to the filing of the final <br />report of the condemnation commissioners to be appointed by the district court; and, <br />WHEREAS, the City engaged independent real estate appraisers to provide the City with the <br />appraisers' opinions of damages caused by the City's acquisition of Real Property Interests <br />needed for Project and the City Council finds that the appraisals are appropriate and fair; and, <br />WHEREAS, the City has made offers to the landowners for the Real Estate Interests consistent with <br />the appraisals, has furnished copies of the appraisals to the respective landowners, and has <br />attempted to negotiate the voluntary acquisition of the Real Property Interests; <br />
