approval of a Special Use Permit within the general business district. The tenant space proposed to be used for <br />auto sales is within the existing building and is less than 200 SF, located at the northwest corner of the building. <br />An interior wall would be constructed to create a separate office space. The applicant's proposed business <br />includes operation of office uses for sale of used, reconditioned vehicles. The business would also include the <br />keeping of no more than 5 vehicles for sale at a given time to be stored outdoors on site, behind the building. <br />The property owner (Tell Ventures LLC) has designated five parking stalls on the east side of the building for <br />the applicant's use. Beyond outdoor storage of no more than five vehicles, no other exterior changes to the site <br />are proposed. The applicant's submitted materials indicate no vehicles will be reconditioned on site and the <br />impact to adjacent and nearby users would only consist of outdoor parking of up to five vehicles at the rear of <br />the building. Sales will be conducted by appointment only, including online marketing. No promotion materials, <br />such as streamers or other typical dealership advertising will be displayed on the property as the applicant <br />intends to keep the business "low profile". One sign will be displayed on the building indicating the name of the <br />business. The applicant does not intend to sell any vehicles with salvage history. Staff recommends approval of <br />the Special Use Permit, subject to the following conditions: <br />1. No more than 5 vehicles, in addition to employee or customer vehicles, are permitted on site during <br />business hours. Further, the applicant may only store a maximum of 5 vehicles on site outside business <br />hours. <br />2. Any vehicles located on the property, whether advertised for sale or not, shall be operable, in good <br />repair, and be properly licensed. <br />3. Inoperable and/or unlicensed vehicles may not be kept on site. <br />4. All vehicles must be located in designated parking stalls, behind the building (east side), at all times out <br />of public view from the street. <br />5. Hours of operation shall be primarily by appointment only but otherwise limited to Monday through <br />Saturday, 7 am to 10 pm and closed on Sunday. <br />6. No balloons, streamers, blow-ups, or the like shall be displayed on site. <br />7. Only a single wall sign in compliance with Chapter 9 of the Zoning Code may be permitted after <br />obtaining a Permanent Sign Permit. <br />Commissioner Nichols-Matkaiti asked why the applicant was limiting his hours of operation to 5:00 p.m. <br />Planning Director Gundlach suggested this condition be amended to read the hours could be extended by <br />appointment only after 5:00 p.m. Joshua Burrs, 581 Old Highway 8 NW, requested the hours of operation be <br />extended until 8:00 p.m. Monday through Friday. <br />Chairperson Howard questioned if it was necessary to have hours of operation given the low level of activity <br />that would occur at this site. Planning Director Gundlach commented that these types of uses had strict <br />conditions in place to ensure that the properties do not become unsightly over time. She anticipated that <br />neighbors would voice their concerns if the applicant were using the site after-hours. <br />Commissioner McPherson was in favor of changing the hours of operation from 8:00 a.m. to 10:00 p.m. to <br />ensure that Mr. Burrs could conduct his business. Mr. Burrs requested that this be made 7:00 a.m. in order for <br />him to meet with clients early in the morning prior to heading to work. <br />Commissioner Danger did not object to this request. <br />Larry Tell, building owner and tenant, explained he was at work every day at 7:00 a.m. and requested that Mr. <br />Burrs be allowed to begin work at that same hour. <br />Mr. Burrs asked if he would be able to grow his business and expand into eight or ten cars. Planning Director <br />Gundlach reported that such an expansion would require an amendment to the Special Use Permit. This request <br />would have to be reviewed by staff and the Planning Commission. <br />Commissioner Deick inquired if Mr. Burrs would like to request eight to ten vehicles at this time. Mr. Burrs <br />commented he would keep his request to five cars at this time. Planning Director Gundlach was in favor of <br />V? <br />
