New Brighton City <br />Code, Chapter 6, Article 1, Section <br />6-1 is hereby amended by adding <br />new definitions as follows: <br />Bees. An insect of a large group <br />of honeybees, who collects pollen <br />and nectar. <br />Coop. A cage or pen used to <br />confine fowl. <br />Fowl. All domesticated barnyard <br />and water birds including, but not <br />limited to, chickens, turkeys, ducks, <br />and geese. <br />Section 2. New Brighton City <br />Code, Chapter 6 is hereby amended <br />by adding an Article 8 as follows: <br />Article 8. Fowl and Bees <br />Sec. 6-200. Purpose. <br />The purpose of this Article is to <br />establish reasonable regulations <br />for the keeping of fowl and bees <br />throughout the City. The City Coun- <br />cil recognizes there is a desire to <br />engage in more sustainable food <br />practices. However, the keeping <br />of certain types of fowl can create <br />unintended negative impacts, in- <br />cluding noise and odors that are not <br />typical of urban environments. The <br />regulations within this Article aim to <br />address the negative impacts that <br />result from keeping fowl within an <br />urban environment. Additionally, in <br />recognition that bees have health <br />implications for certain individuals, <br />this Article establishes minimum <br />hive standards and notification re- <br />quirements. <br />Sec. 6-201. Number of Fowl. <br />The keeping of fowl shall not ex- <br />ceed a total of six per property on all <br />property throughout the City. <br />Sec. 6-202. Flock Notification. <br />Any property owner who keeps <br />fowl shall notify the City's Code <br />Compliance Inspector, or designee, <br />of all flock locations within the City. <br />Sec. 6-203. Outdoor Butchering. <br />No outdoor butchering of fowl is <br />permitted. <br />Section 6-204. Minimum Coop <br />Size. <br />Under no circumstances shall <br />coop size be less than three (3) <br />square feet per fowl kept. <br />Section 6-205. Coop Standards. <br />All coops shall be: <br />(1) Clean and sanitary; <br />(2) Made of sound construction <br />and craftsmanship; <br />(3) Be maintained so they remain <br />structurally sound; <br />(4) Protect the fowl from the <br />weather; <br />(5) Be located in the rear/back <br />yard and meet the most restrictive <br />of the following setbacks: <br />a. 5 feet from side and rear prop- <br />erty lines. <br />b. 25 feet from residences on ad- <br />acent and nearby lots. <br />c. A setback from adjacent and <br />,iearby residences a distance at <br />east equal to the distance the coop <br />s placed from the residence on the <br />subject property. <br />d. 25 feet from a lake, wetland, <br />pond, stream, tributary, drainage <br />ditch or the like. <br />e. All other structure or building <br />setbacks required under the Zoning <br />Code. <br />(6) Not be located inside a pri- <br />mary residence or place of busi- <br />ness; and <br />(7) Follow best practices for <br />nests. <br />Section 6-206. Restraining Fowl. <br />All fowl shall be prohibited from <br />running at large off of the owner's <br />property. <br />Section 6-207. Roosters. <br />All roosters are prohibited. <br />Section 6-208. Hive Notification. <br />Any property owner who keeps <br />bees shall notify the City's Code <br />Compliance Inspector, or designee, <br />of all hives the person intends to es- <br />tablish within the City. <br />Section 6-209. Water Source Re- <br />quired. <br />Any property owner who keeps <br />bees shall provide and maintain a <br />nearby, designated water source. <br />Section 3. Any property owner <br />that started keeping bees or fowl <br />prior to the effective date of this <br />ordinance shall have six months <br />from its date of publication to come <br />into compliance with its provisions, <br />except that existing flocks shall be <br />reported to the City's Code Com- <br />pliance Inspector, or designee, per <br />Section 6-202 within 90 days. <br />Section 4.
