All residential Subscribers who receive all or any part of the total services offered <br />on the System shall be eligible to receive the Access Channels at no additional <br />charge. City may rename, reprogram, or otherwise change the use of these <br />channels in its sole discretion, provided such use is non-commercial, lawful, and <br />retains the general purpose of the provision of community programming. Nothing <br />herein shall diminish the City's rights to secure additional channels pursuant to <br />Minn. Stat. § 238.084, which is expressly incorporated herein by reference. City <br />shall provide ninety (90) days prior written notice to Grantee of City's intent to <br />activate access channels. <br />d. Grantee may not move or otherwise change the channel number or location of any <br />public or government access or community program channel, including the North <br />Suburban Mosaic channel, without the written approval of the City or its <br />designee. Upon six (6) months' notice to City, any other access channel may be <br />moved by Grantee, but in no event more than once every two (2) years unless <br />otherwise allowed by City, provided Grantee pays all reasonable costs or <br />expenses arising out of the channel move including, but not limited to, equipment <br />necessary to effect the change at the programmer's production or receiving <br />facility (school frequency routing equipment, etc.), signage, letterhead, business <br />cards, and reasonable marketing or other constituency notification costs. This <br />paragraph shall not apply to Regional Channel 6. <br />2. Charges for Use. Channel time and playback of programming on the PEG access <br />and community program channel(s) must be provided without charge to City and the public. <br />3. Access Rules. City, or its designee, shall implement rules for use of any access <br />channel(s). <br />4. Access _Support. Grantee shall pay a PEG Fee of $4.15/subscriber/month from the <br />effective date until the franchise renews. Starting with the 2016 calendar year, the City may <br />elect to increase this fee based on the Consumer Price Index. Any such election must be made <br />in writing to the Franchisee no later than September I" prior to the year in which the increase <br />shall apply. In no event shall the PEG Fee be in an amount different from the incumbent cable <br />provider. In the event the incumbent recovers from subscribers a higher, or lower, PEG fee, <br />Grantee will increase, or decrease, its PEG fee upon ninety (90) days written notice from the <br />City. The PEG fee may be used for operational or capital support of PEG programming. <br />5. Regional Channel 6. Grantee shall designate standard VHF Channel 6 for <br />uniform regional channel usage. <br />6. State and Federal Law compliance. Satisfaction of the requirements of this <br />Section 6 satisfies any and all of Grantee's state and federal law requirements of Grantee with <br />respect to PEG access. <br />7. Future PEG Funding, Obligations. Grantee agrees that financial support for PEG <br />arising from or relating to the obligations set forth in this Section shall in no way modify or <br />
