AGREEMENT NO <br />06739 <br />DATED <br />USDOTNO: <br />463547W (D377613) <br />STATE PROJECT <br />88RM-173 <br />FUNDS <br />100% STATE (HSA) <br />Grade Crossing Closure <br />Spring Creek Drive (MI), City of New <br />Brighton, Ramsey County, Minnesota <br />Minnesota Commercial Railway <br />THIS AGREEMENT, made and entered into by and between the CITY OF NEW BRIGHTON <br />(City), and the STATE OF MINNESOTA through its COMMISSIONER OF TRANSPORTATION (State), <br />RECITALS: <br />1. Spring Creek Drive (MI), USDOTNO. 463547W as now established, crosses the tracks of the <br />Minnesota Commercial Railway at grade in the City of New Brighton, Ramsey County, MN; and <br />2. The City and State agree that closing crossing USDOTNO. 463547W is in the best interest of the <br />traveling public; and <br />3. Elimination of a grade crossing by closing the crossing includes the permanent closure of the <br />roadway (Multi -use pathway will remain) across the Minnesota Commercial Railway right-of-way; and <br />4. The State agrees to pay the City a Lump Sum payment of $25,000.00. <br />5. The City in cooperation with the Minnesota Commercial Railway (under separate agreement), <br />and State will permanently close the roadway at -grade crossing USDOTNO. 463547W; and <br />6. The State, pursuant to Minnesota Statute Section 161.20 is authorized to enter into an agreement <br />with the parties for the work. <br />
