Director of Community Assets & <br />Development/Planning Director <br />SUBJECT: Follow -Up — February 3rd Urban Farming Work Session <br />Per the Council's direction, staff prepared additional follow-up materials based on <br />discussion that occurred at the February 3rd work session. For reference, staff has <br />attached a print-out of the white board discussion that occurred. This discussion provided <br />direction to staff on what areas were appropriate for additional regulation and what areas <br />the Council felt the status quo was acceptable. <br />As noted in the "Council Vote" section of the print-out (far right column), 3 of 4 Council <br />members elected for proposed regulation in the areas of fowl, coops, roosters, and bees. <br />During the February 3rd work session discussion; there was only agreement by 3 of 4 <br />members to enact regulation in these areas, but not necessarily the specific regulations <br />recommended by the Urban Farming Task Force. Staff prepared a draft Ordinance for <br />discussion, which codifies the regulations as recommended by the Urban Farming Task <br />Force, with one exception regarding roosters. The attached draft Ordinance includes a <br />ban on all roosters, which has been recommended by staff based on complaints that have <br />occurred after the task force concluded their analysis. The Council should discuss <br />whether this is appropriate, along with whether the other sections of the draft Ordinance <br />are appropriate, specifically the maximum number of fowl based on lot size. <br />The proposed Ordinance would create a new Article 8 to Chapter 6 of the City Code, <br />which is currently titled Animals and Fowl. Because the chapter doesn't have any <br />regulations for fowl, staff felt it was appropriate to include these regulations within a new <br />Article 8. The City Attorney has reviewed the draft Ordinance and provided comment. <br />Lastly, during the February 3rd work session there was discussion regarding the total <br />number of complaints on fowl, roosters, and bees and whether that number was indicative <br />of the necessity to adopt regulations. Staff felt it was appropriate at this time to note the <br />Urban Farming Task Force discussed/struggled with this issue as well. The City <br />
