RESOLUTION No. <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION ENACTING WATER CONSERVATION PLAN <br />WHEREAS, the City of New Brighton's primary source of water is now four wells in the Mt. <br />Simon Hinckley aquifer, and these wells may not be capable of meeting consumer demand during <br />periods of peak use; and <br />WHEREAS, weather, mechanical failures, and availability of water in the Mt. Simon Hinckley <br />aquifer could further reduce the volume of water available; and <br />WHEREAS, the 1989 Ground Water Act limits the use of water from the Mt. Simon -Hinckley <br />aquifer for drinking water only and "prohibits the use of this resource for lower priority and nonessential <br />purposes such as lawn watering;" and, <br />WHEREAS, Minnesota State Statutes § 103G.291 Subdivision 4 (b) requires all public water <br />suppliers serving more than 1,000 people to implement water demand reduction measures by January 1, <br />2015; and, <br />WHEREAS, the New Brighton City Council has a desire to protect our community's natural <br />resources; and, <br />WHEREAS, New Brighton City Code § 30-10 permits the City Council to establish by resolution <br />limited days and hours for the sprinkling and watering of yards and gardens or other usages of water from <br />the municipal water system; <br />NOW THEREFORE, BE IT RESOLVED that the City Council of the City of New Brighton adopts a <br />summer watering restrictions program (Appendix A) and that the City Manager or his designee is <br />authorized to declare and advertise the water conservation status, enact the outlined restrictions, and <br />publicly post said status and restrictions; and <br />THEREFORE, BE IT ALSO RESOLVED by the City Council of the City of New Brighton that the <br />City Manager is authorized to implement additional water conservation measures at such times where the <br />water demand exceeds supply capabilities or when public water reserve capacities are insufficient to <br />protect the community; and <br />THEREFORE, BE IT ALSO RESOLVED by the City Council of the City of New Brighton that a <br />person who is knowledgeable of the status and restrictions and does use water from the municipal water <br />system for activities prohibited by the restrictions shall be guilty of a misdemeanor as provided for in <br />New Brighton City Code § 30-11. <br />ADOPTED this 9th day of June, 2015 by the New Brighton City Council with a vote of ayes and <br />nays. <br />ATTEST: <br />Terri Haarstad, City Clerk <br />Dave Jacobsen, Mayor <br />Dean R.
