COf <br />,na EW <br />BRIGHTON <br />the city that works for you <br />2N <br />AGENDA SECTION: Public Hearings <br />REPORT DATE: November 25, 2015 <br />MEETING DATE: December 1, 2015 <br />REQUEST FOR CITY COUNCIL CONSIDERATION <br />ITEM DESCRIPTION: SECOND PUBLIC HEARING FOR PROPERTY ACQUISITION BY <br />EMINENT DOMAIN FOR PROJECT 16-1,2016 STREET REHABILITATION. <br />DEPARTMENT HEAD'S APPROVAL: Craig Schlichting, Director of Community Assets and <br />Development <br />CITY MANAGER APPROVAL: <br />No comments to supplement this report Comments attached <br />Recommendation: To hold a Public Improvement Hearing for Property Acquisition by Eminent <br />Domain for Project 16-1, 2016 Street Rehabilitation. <br />Legislative History: <br />April 30, 2105 Neighborhood Informational Meeting <br />June 18, 2015 City Council accepted Feasibility Study and set Public Hearing <br />July 14, 2015 Public Hearing and Approved Project, KHA plan design, hired appraiser <br />October 13, 2015 Authorized Director of Community Assets and Development to send offer letters <br />to affected properties based on appraised values <br />November 24, 2015 First Public Hearing Regarding Condemnation <br />Notices of the three Public Improvement Hearings were sent to the property owners and published in the <br />local newspaper. <br />Financial Impact: Patchin Messner Dodd & Brumm has prepared market value appraisals of private <br />property that is needed to accommodate Project 16-1 improvements. This consists of the following <br />properties: <br />5195 th Avenue Northwest <br />401 County Road E2 <br />2515 th Street Northwest <br />Explanation: The majority of project improvements for City Project 16-1, 2016 Street Rehabilitation <br />will be constructed within existing right-of-way. However, the proposed improvements will require <br />acquisition of right-of-way, drainage and utility easements, and temporary construction easements. <br />Staff is currently working with all three of the properties that are impacted by the proposed project. <br />Two of the three properties have indicated their willingness to work with the City on the improvements <br />in the corridor. Based on these properties having a mortgage, it is necessary to have the bank/lender <br />sign their consent to the proposed property easements. To secure mortgage consent it may take <br />
