d. Reasonable setbacks are imposed to other uses, mitigating wind, dust and sound effects <br />from the helipad. <br />e. Existing mature trees will be preserved and provide screening from Old Highway 8 NW. <br />f. The proposed 36"-42" hedge surrounding the landing pad will provide wind and dust <br />mitigation for The View apartments to the west. <br />g. The helipad site maintains pedestrian linkages required through the PUD, with <br />connections to the sidewalk on Northwest Parkway and to the headquarters building. <br />h. Hours of operation will be honored. <br />i. Flight paths are east/west, greatly reducing the number of properties impacted by noise. <br />j. The applicant has demonstrated that noise produced by the helicopter will only increase <br />the maximum level of noise by approximately 5-7 decibels, depending on location. <br />1. Maximum decibels levels identified cannot be exceeded. <br />in. The helipad will comply with Building & Fire Code standards. <br />n. The site will produce no impacts to the public 345 days of the year. <br />o. Take -off and landing time limitations and steep ascents and descents will greatly reduce <br />noise impacts. <br />Now THEREFORE BE IT RESOLVED that based upon the above findings of fact the application <br />for a Special Use Permit (SP2015-006) is hereby approved, subject to the following <br />conditions: <br />1. City Council adoption of proposed Ordinance 835. <br />2. Construction of the helipad consistent with the Site Plan submitted and attached as Exhibit L <br />to the Planning Report dated 6/12/2015, additionally the hedge must be maintained at a <br />height of 36"-42" to provide a consistent barrier from the helipad to adjacent sidewalks. <br />3. The helipad continuously complies with the provisions of Zoning Code Section 6-693(C). <br />Any deviation from these conditions will constitute non-compliance with the Special Use <br />Permit. <br />4. In an effort to confirm compliance with Section 6-693(C), item 5, the applicant shall furnish <br />flight logs to City staff on a yearly basis, oils or within 30 days of January 30tH <br />5. Allowed landings shall be for personal use of the property owner only and shall not be used <br />by a third party, except in emergency situations. <br />6. Applicant submits to the City copies of secured FAA and MnDOT permits for the helipad. <br />7. The flight paths shall consist only as provided in Exhibit I of the Planning Report dated <br />6/12/2015. Further North/south or south/north landings and take -offs shall be prohibited. <br />8. Helicopter noise associated with the helipad shall not exceed the following decibel levels <br />measured at ground level: <br />a. A maximum of 93 dB within a 250' radius of the helipad and a 12 hour average decibel <br />level of no more than 86 dB. <br />b. A maximum of 91 dB within a 250' — 375' radius of the helipad and a 12 hour average <br />decibel level of no more than 78 dB. <br />c. A maximum of 84 dB within a 375' — 800' radius of the helipad and a 12 hour average <br />decibel level of no more than 81 dB. <br />�.
