She congratulated Erin Nichols Matkaiti on <br />being appointed the new Planning Commission Chair. <br />4 Ayes, 0 Nays - Motion Carried <br />Public Hearine <br />Consideration of a Resolution approving a Minor Subdivision for Bruce Knight, <br />impacting property located at 20 32"d AVE NW and 50 32"d AVE NW. <br />Motion by Councilmember Burg, seconded by Councilmember Jacobsen to open the <br />Public Hearing. <br />4 Ayes, 0 Nays - Motion Carried <br />The Public Hearing was opened at 7:07 p.m. <br />City Manager Lotter indicated Assistant Director of Community Assets and DevelopmentlPlarnling Director <br />Gundlach would be presenting this item to the Council. <br />Assistant Director of Community Assets and DevelopriientfPlanning Director Gundlach explained the <br />applicant is requesting a minor subdivision, subdividing off a 10' x 140' (1,400 SF) parcel <br />from 20 32nd AVE NW (depicted on the attached survey as "area to be transferred from <br />Gregory Parcel to Knight Parcel"). The intent of the proposed subdivision is not to create a <br />new developable lot, rather to allow the adjacent property at 50 32nd AVE NW to obtain <br />additional land to accommodate an existing retaining wall system. The proposal would be <br />conditioned on the newly subdivided parcel being legally combined with 50 32nd AVE NW. <br />Both 20 and 50 32nd AVE NW, pre and post subdivision, meet the minimum area and width <br />standards of the R-1, Single Family Residential zoning district. The applicant, who is the <br />owner of 50 32nd AVE NW, wishes to obtain additional land to accommodate some timber <br />retaining walls that were constructed years ago unknowingly outside the property boundary. <br />While the proposed subdivision doesn't eliminate 100% of the encroachment, it gets very close <br />and the applicant intends to physically remove the additional 1'-2' of retaining wall in the near <br />future so as to remove all encroachments. Until that occurs, a private easement agreement <br />between the landowners has been negotiated. The owner of the parcel to be subdivided (20 <br />32nd AVE NW) has consented to the subdivision by signing the Land Use Application. City <br />Code Section 26-18 outlines which projects are eligible for Minor Subdivision approval verses <br />a Preliminary and Final Plat. Because this subdivision is of small size and conditions are well <br />defined, only a Minor Subdivision is necessary. As stated in Section 26-18 (1) the City Council <br />Page 3 of 11 <br />6.
