Post subdivision, both <br />lots will be in compliance with the 5,000 SF minimum lot area and 40' lot width requirements <br />for the R -IA, Single Family Residential zoning district. The existing home would remain on <br />the northerly lot (Parcel B) and the applicant would sell the newly subdivided southerly lot <br />(Parcel A) for development. The proposed subdivision results in one, new single-family <br />residential unit. A survey is attached depicting the proposed subdivision and noting the <br />proposed legal descriptions of the subdivided lots. There are various development fees that will <br />be due at the time a building permit is requested for construction of a new house on proposed <br />Parcel A. These fees include, but are not limited to, a Sewer Access Charge through the <br />Metropolitan Council ($2,485) and a park dedication fee ($1,754). City Code Section 26-18 <br />outlines which projects are eligible for Minor Subdivision approval verses a Preliminary and <br />Final Plat. Because this subdivision is of small size and conditions are well defined, only a <br />Minor Subdivision is necessary. As stated in Section 26-18 (1) the City Council shall hold the <br />public hearing after proper published and mailed notice to property owners within 350'. Proper <br />published and mailed notice has been given. As of the drafting of this memo, one inquiry has <br />been received and there are no known objections. Staff recommended approval of the <br />subdivision, subject to the payment of appropriate development fees at the time of building <br />permit and access permitted by Ramsey County. <br />Mayor Johnson asked how long Mr. Knstyniak has lived in his home. William Kristymak, 778 Old <br />Highway 8 NW, reported he was born in that home, 73 years ago. He explained he was proposing the lot <br />split to reduce the maintenance he has on his yard. <br />Doug Rainer, civil engineer, discussed the three-foot high retaining wall along the front yard. He asked if the <br />new lot would be accessed off Old Highway 8. Assistant Director of Community Assets and <br />Development/Planning Director Glmdlach stated there was a reta=ining wall that runs along Old Highway 8 <br />due to the significant topographical change from the road to the green area. She reported the applicant could <br />obtain a driveway permit from Ramsey County for access to Old Highway 8 or a shared access could be <br />provided from Mr. Knstymak's existing driveway. <br />Mayor Johnson asked for additional comments, there were none. <br />Motion by Councilmember Jacobsen, seconded by Councilmember Burg to close the <br />Public Hearing. <br />4 Ayes, 0 Nays - Motion Carried <br />The Public Hearing was closed at 7:32 p.m. <br />Motion by Councilmember Jacobsen, seconded by Councilmember Burg to Adopt a Resolution <br />approving the subdivision, subject to payment of appropriate development fees at the <br />time of building permit and access permitted by Ramsey County. <br />4 Ayes, 0 Nays -Motion Carried <br />Council Business <br />1.
