I <br />1 <br /> <br />I <br /> <br />e <br /> <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING VN.311. <br /> <br />WHEREAS, an application for a variance has been made by Twin Cities Habitat for Humanity; and. <br /> <br />WHEREAS, the procedural history ofthe application is as follows: <br /> <br />1. An application for a variance was filed with the City of New Brighton on March 28, 1997. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on April 15, 1997, and all persons present at the hearing were given an opportunity to be <br />heard. <br />3. The City Council considered VN-311 at the April 22, 1997, City Council meeting. <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />respect to VN-311 : <br /> <br />Ii <br />Ii <br />'I <br />II <br />Ii <br /> <br />I <br /> <br />i, _ <br />,I - <br /> <br />1. The property is zoned R-l A, Single Family Residential. <br />2. The required lot standards in the R-l A district is 40 feet of lot width and 5,000 square feet of <br />lot area. <br />3. The subject lot is 40 feet wide and 4,920 square feet in area. <br />4. The subject lot would require an 80 square foot lot area variance. <br />5. A variance may be granted from the literal provisions of the Zoning Ordinance in instances <br />where strict enforcement would cause an undue hardship because of unique circumstances <br />and when it is demonstrated that such a variance would be consistent with the spirit and <br />intent of the ordinance. The unique circumstance in this case is that several lots having less <br />than 5,000 square feet of lot area already exist in this neighborhood and are developed with <br />single family homes. Therefore, strict enforcement of the City's minimum lot width <br />standards would cause the applicant an undue hardship and would not allow the applicant to <br />put the subject property to a reasonable use. <br />6.
