<br />RESOLUTION No. 9 1 <br />7-0 5 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING AN A PPLlCA nON FOR SP-I97. <br /> <br />WHEREAS, an application for a special use permit has been made by the City of New Brighton to permit the <br />installation of a well and pump house on property adjacent to the Belair School site; <br /> <br />WHEREAS, the procedural history of the application for a is as follows: <br />1. An application for extending SP-197 was filed with the City of New Brighton on January 31, 1997. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing on February <br />18, 1997, and all persons present at the hearing were given an opportunity to be heard. <br />3. The City Council considered SP-I97 at its February 25, 1997 meeting. <br /> <br />.' <br /> <br />i; <br /> <br />Now, THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect to SP-I97: <br /> <br /> i <br />, , 4. <br />! <br />, i 5. <br /> i 6, <br /> , <br />i , 7. <br /> 8. <br /> 9. <br /> <br />!I <br /> <br />1. The subject site is zoned R-l, Single Family Residential. <br />2. A well and pump house is a special use in the R-l district, according to Section 4-030 of the New <br />Brighton Zoning Code. <br />3. The City of New Brighton (the City) may grant a special use permit for such a use within the R-l <br />district only if the use meets the standards specified in Section 8-130 ofthe New Brighton Zoning <br />Code, which standards follow: <br />a. That the establishment, maintenance, or operations ofthe special use will not be detrimental to <br />or endanger the public health, safety, morals, comfort of general welfare; <br />b. That the special use will not be injurious to the use and enjoyment of other property in the <br />immediate vicinity for the purposes already permitted, nor substantially diminish and impair <br />property values within the neighborhood; <br />c. That the establishment ofthe special use will not impede the normal and orderly development <br />and improvement of the surrounding property for uses permitted in the district; <br />d. That adequate utilities, access roads, drainage and/or necessary facilities have been or are being <br />provided; <br />e. That the special use shall, in all other respects, conform to the applicable regulations ofthe <br />district in which it is located. <br />The location of the well and pump house adjacent to the Belair School site has been formally approved <br />by the Board ofthe Independent School District 621. <br />As part ofthe agreement between the US Anny and the City of New Brighton, the proposed well along <br />with other existing similar wells in the City, is required to contain an area of contamination in the <br />groundwater beneath New Brighton. <br />The well house or pump house would measure 16 by 30 feet, would be constructed of materials which <br />would reduce any potential noise, and would have a stucco exterior finish. <br />The groundwater would be pumped to the City's water treatment plant for removal of contaminants and <br />then to the City's drinking water system. <br />A small portion of the Belair School site would be split offto accommodate the well and pump house. <br />The well and pump house would comply with the New Brighton Zoning Code, Section 8.130 (a), (b), <br />(c), (d), and ( e) special use permit standards. <br /> <br />_- --1. <br /> <br />BE IT FURTHER RESOLVED, the application for SP-197 is hereby approved, subject to the following condition: <br /> <br />Approval of PL- 231. <br /> <br />AdQpted this 25~ day of February, 1997. <br /> <br />i1 <br /> <br />~ <br />::1~/;~ <br />Ma ew S.
