<br />~ <br /> <br />1 <br /> <br /> <br />I · <br /> <br />RESOLUTION No. 96~10 5 <br /> <br />CITY OF NEW BRIGHTON <br /> <br />I <br />!RESOLUTION MAKING FINDINGS OF FACT AND APPROVING SP-196. <br /> <br />WHEREAS, an application for a special use permit has been made by the City of Minneapolis; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br /> <br />1. An application for a special use permit was filed with the City of New Brighton on August <br />30, 1996. <br /> <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on September 17, 1996, and on October 15, 1996, and all persons present at the hearing were <br />given an opportunity to be heard. <br /> <br />3. The Planning Commission also considered updated infonnation pertaining to SP-196 at it's <br />November 19, 1996, meeting. <br /> <br />4. The City Council considered SP-196 at it's October 22 and November 26, 1996 meetings. <br /> <br />5. O~ December 12, 1996, members of the New Brighton and Columbia Heights City Councils, <br />City staff, School District #13 representatives, County engineers, and the Minneapolis Water <br />Works staff, held a joint work session to discuss truck hauling routes and related matters <br />concerning the proposed water reservoir. <br /> <br />6. The City Council considered SP-196 at it's December 18, 1996 meeting. <br /> <br />) Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br />Irespectto SP-196: <br /> <br />I L The subject site is zoned R -I, Single Family Residential and the proposed 40 million gallon <br />underground finished water reservoir facility is a Special Use in the R-I district. <br /> <br />2. The proposed underground finished water reservoir would comply with R-I district setback <br />standards and it would not have adverse impacts if it were adequately screened from adjacent <br />residential properties and public right of ways. <br /> <br /> <br />3. The proposed water reservoir does exceed the R-l district Floor Area Ratio standard of 30% <br />by 3%. <br /> <br />4. The establishment, maintenance, or operations of the proposed underground finished water <br />reservoir will not be detrimental to or endanger the public health, safety, morals, comfort, or <br />general welfare. <br /> <br />5. The underground finished water reservoir will not be injurious to the use and enjoyment of <br />other property in the immediate vicinity for the purposes already permitted, nor substantially <br />diminish and impair property values within the neighborhood. <br /> <br />G:ICDI-96-CCREISP-196C.WPD <br />
