ORDINANCE NO. 848 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />AN ORDINANCE AMENDING ARTICLE 4 OF CHAPTER 26 OF THE CITY CODE <br />REGARDING THE DETERMINATION OF THE AMOUNT OF PARK DEDICATION FEES <br />THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS as follows: <br />Section One. New Brighton City Code, Chapter 26, Section 26-50 (4) is amended by deleting the stricken <br />language and adding the underlined language as follows: <br />(4) Contribution in Lieu of Land At the City's option, the subdivider shall contribute an amount in cash <br />in lieu of all or a portion of the land required under Section 26-50 (1). The contribution amount shall be <br />esiablished--ley reseltition and. in the ease of residential subdiNiisiaB, sliall be based aB the RuFnher iind Vjp�e <br />SUbdiii9ieH Will be —based enthe area the subdivisien determined prior to the City granting final <br />approval. The amount of any cash in lieu contribution shall be based on the averse fair market value of <br />the land that would otherwise be required to be dedicated. For the purposes of this section, "fair market <br />value" means the value of land as determined by the City annually based on tax valuation or other <br />relevant data, and set forth in the City's fee schedule. If the applicant disputes the amount of the <br />proposed cash in lieu contribution, the applicant, at the applicant's expense, may obtain an independent <br />appraisal of the property. The appraisal must be -made by a certified real property appraiser who is <br />licensed in the State of Minnesota_ and holds a MAI membership designation from tete Appraisal Institute, <br />or equivalent certification. If the City disputes the appraisal the City may, at the applicant's expense, <br />obtain an Appraisal of the ro erly by an appraiser that meets the requirements of this 12aragral2h. In that <br />event, the fair market value of the land shall be determined by averaging the two appraisals, <br />Section Two.
