Director of Community Assets & <br />Development/Planning Director <br /> Craig Schlichting, Director of Community Assets & Development <br /> <br />SUBJECT: Temporary Housing Legislation (also referred to as Drop Homes) <br /> <br />On May 12, 2016 the Governor signed into law a new bill concerning temporary <br />dwellings, or transitional housing, for those with mental and/or physical disabilities. The <br />new legislation goes into effect on September 1, 2016 and has zoning implications for <br />communities. <br /> <br />Purpose <br />The purpose of the new law is to provide transitional housing for seniors who can’t afford <br />(or choose not) to recover in traditional transitional housing, such as a nursing home. <br />The law defines eligible persons as anyone who needs assistance with two or more <br />“instrumental activities of daily life” for mental or physical reasons. While its purpose <br />was to provide housing options for seniors, the law does not include age as a criterion. <br /> <br />Effect of Law <br />The law supersedes any local zoning ordinances in that this type of housing cannot be <br />prohibited through existing accessory use, recreational vehicle, or outdoor storage <br />ordinances. The law creates a permit referred to as a Temporary Dwelling Permit, which <br />includes the following requirements: <br /> Six-month duration, with an option to extend an additional six months. <br /> The permit must be issued to the property where the caregiver OR relative resides. <br /> Allows “temporary dwellings” to include recreational vehicles, modular and <br />prefabricated housing not to exceed 300 SF and not affixed to a permanent <br />foundation. <br /> Be handicap accessible. <br /> Have access to water and electricity. <br /> The dwelling must have septic service and the applicant must show proof of <br />septic service management. <br /> Equipped with an anti-backflow valve.
