<br />14 <br />483433v3 NE136-8 <br /> <br />3.5 Performance Monitoring <br /> <br />The City will monitor the performance of the Contractor against goals and performance <br />standards required within this Agreement. Substandard performance as determined by <br />the City will constitute non-compliance. If action to correct such substandard <br />performance is not taken by the Contractor within 60 days after being notified by the <br />City, the City may initiate the Contract termination procedures. <br /> <br />3.6 End Market Certification <br /> <br />The Contractor shall provide at least annual written certification to the City that all <br />recyclable commodities identified are indeed recycled and not disposed. <br /> <br />4. PAYMENT AND DAMAGES <br /> <br />4.1 Compensation to Contractor: <br /> <br />The City agrees to pay the Contractor $2.78 per household unit, per month, for 2017, <br />$2.86 for 2018, $2.95 for 2019, $3.04 for 2020, $3.13 for 2021, $3.22 for 2022 and $3.31 <br />for 2023 for curbside collection every other week, processing and marketing of <br />recyclable materials. For 2017, the City certifies that there are ___________ curbside <br />units that will receive service. By February 1st of each year, the City will review the <br />number of certified units and notify the Contractor of any changes. <br /> <br />4.2 Method of Payment to the Contractor <br /> <br />The Contractor shall submit itemized bills for recycling collection services provided to <br />the City on a monthly basis. Bills submitted shall be paid in the same manner as other <br />claims made to the City. <br /> <br />The Contractor shall submit the monthly documentation and reports with the monthly bill <br />as detailed in Section 2.22. Payment to the Contractor will not be released unless the <br />required paperwork is included in the monthly bill or submitted separately according to <br />the deadlines as specified in Section 2.22. <br /> <br />4.3 Liquidated Damages <br /> <br />The Contractor agrees, in addition to any other remedies available to the City, that the <br />City may withhold payment from the Contractor in the amounts specified below as <br />liquidated damages for failure of the Contractor to fulfill its obligations. <br /> <br />The following acts or omissions shall also be considered a breach of this Agreement: <br /> <br />a) Failure to respond to legitimate service complaints within 24 hours in a reasonable <br />and professional manner - $50 per incident.
