 Provides fencing standards for the shoreland similar to existing zoning regulations, except: <br />o A provision is included that would not permit construction of a fence or wall with the <br />shore impact zone (1st 25’or 75’ based on water classification) and, <br />o Restricts fence construction type (no privacy fences) and height (3 ½’) within the <br />remaining shoreland setback (up to 50’ or 150’ based on water classification). <br /> Limits vegetation clearing. <br /> Limits grading, filling, and excavation activities of more than 10 cubic yards within the shore <br />impact zone and bluffs and 50 cubic yards within the entire shoreland. <br /> Establishes minimum standards for roads constructed within the shoreland. <br /> Establishes minimum standards for stormwater management within the shoreland. <br /> Requires all lots within the shoreland to be connected to public water and sanitary sewer. <br /> <br />The draft ordinance is attached as Attachments A and C. In an effort to resolve comments from <br />the City Attorney and the DNR, changes to the ordinance as provided in Attachments A and C <br />will occur over the next 45 days. An updated draft ordinance will be presented to the Planning <br />Commission in April, after outstanding issues have been resolved. <br /> <br />CITY ATTORNEY & DNR COMMENTS <br />Both the City Attorney and the DNR has provided comments on the draft Shoreland Ordinance. <br />These comments are contained in the right margin of the draft ordinance attached as Attachment <br />A (City Attorney comments) and C (DNR comments). Staff has also provided a comment <br />response sheet, explaining what is being done with each comment (see Attachments B and D). <br /> <br />NEXT STEPS <br />Staff will work, over the next 45-60 days, on resolving any outstanding issues and incorporating <br />all City Attorney and DNR comments into an updated draft ordinance. Staff will present an <br />updated ordinance to the Planning Commission on April 19, 2016. <br /> <br />To date, staff has sent written notices to property owners in the defined shoreland twice: 1) <br />inviting them to the Open House last September, and 2) inviting them to this public hearing. <br />Since there are 1,518 property owners within the defined Shoreland, providing individual written <br />notice is time consuming and costly. Since the City has met its legal obligation with the notices <br />already sent, the public should be put on notice that additional hearing notifications will NOT be <br />mailed and if residents want to continue to follow the process they should visit the City’s website <br />for updated information and/or attend the April 19, 2016 Planning Commission meeting. <br /> <br />STAFF RECOMMENDATION <br />Hold the public hearing and accept testimony. <br /> <br />Table action to the April 19, 2016 Planning Commission meeting to allow staff additional time to <br />work with the City Attorney and the DNR on unresolved regulations within the proposed <br />ordinance. <br /> <br /> <br />Janice Gundlach <br />Assistant Director of Community Assets & <br />Development/Planning Director <br /> <br />
