CITY STAFF RESPONSES TO CITY ATTORNEY COMMENTS ON DRAFT <br />SHORELAND ORDINANCE (AS OF 2/11/2016) <br />COMMENT RESPONSE <br />A1 This is understood. Staff will work with the DNR to obtain <br />approval of any deviations from State rules. <br />A2 The DNR has officially commented via email on January 28, <br />2016. City staff will continue this dialogue. <br />A3 Comment will be implemented. <br />A4 Staff will implement definitions for the items listed, as needed, <br />based on the draft standards, what is already defined in the <br />Zoning Code, and what the DNR will require. <br />A5 The DNR has commented this should be 30 feet (not 20’ or <br />40’), staff will implement this change. <br />A6 The 75’ width requirement is compliant. Staff will work with <br />the DNR on the minimum lot area requirement (10,000 vs. <br />20,000 SF). This issue is minor being most of the lakeshore in <br />New Brighton is already developed. <br />A7 Staff will seek approval from the DNR for a 30’ height <br />allowance as 30’ is what is allowed under existing residential <br />zoning requirements and nearly all the shoreland has been <br />developed already under this standard. <br />A8 Similar DNR comment – staff will work with the DNR on this <br />issue, with the intent to implement a percentage higher than <br />25% based on existing impervious surface coverages. <br />A9 Similar DNR comment – staff will examine commercial <br />standards of the state rules and implement what is appropriate. <br />It should be recognized there are existing commercial/industrial <br />uses within the defined shoreland and those property owners <br />cannot be unduly burdened from improving their property. <br />Unclear what “water commercial use” is? Will work with the <br />DNR. <br />A10 DNR has signaled they will accept 50’ for Jones Lake. <br />A11 DNR has signaled they will accept 50’ for Poplar Lake. <br />A12 No new wells will be drilled in the City so this comment does <br />not apply. <br />A13 Comment will be implemented. <br />
