 Planned Developments was added as a land use application triggering DNR Notification <br />Procedures. <br /> The lot area minimum standard for the Shoreland was revised to require a minimum lot <br />area for new riparian lots to be 20,000 SF verses the 10,000 SF minimum currently in <br />place for R – 1 zoned property. While not 100% consistent with the state rule, staff finds <br />this is a reasonable compromise given New Brighton’s characteristics. This will have <br />little impact being most riparian lots are already substantially deeper than the typical <br />residential lot in New Brighton. <br /> Staff has provided the DNR a narrative outlining why New Brighton should be permitted <br />a 50% hardcover limitation. See the response to DNR comment JS14 on the attached <br />table. <br /> A Top of Bluff setback has been added to the Setback Requirements section of the draft <br />ordinance. This should have little impact being New Brighton only has one somewhat <br />significant bluff on the north side of Rush Lake. <br /> Standards for “commercial, industrial, public, and semi public uses” have been added <br />being there is industrial-zoned property north of Jones Lake. <br /> A standard prohibiting “Intensive Vegetation Clearing” has been added to the Shoreland <br />Vegetation Alternations section. <br /> The term “impervious surface” has been added to the Roads section of the ordinance. <br /> A sentence has been added to the end of the ordinance clarifying the ordinance will <br />become effective the day following its publication in the official City newspaper. <br /> <br />CITY ATTORNEY & DNR COMMENTS <br />Both the City Attorney and the DNR has provided comments on the draft Shoreland Ordinance. <br />Their comments have been incorporated into the latest draft. Staff has provided tables, updated <br />since the last meeting, which discusses how these comments were addressed within the latest <br />draft ordinance. <br /> <br />NEXT STEPS <br />Staff was unable to address the DNR comments from February within in timetable that would <br />have allowed for the DNR to respond in advance of the April 19th meeting. Staff suggests <br />providing additional time to the DNR for review and comment on the draft ordinance dated 4-11- <br />2016. Staff anticipates comments will be returned in time for the May 17th meeting. <br /> <br />STAFF RECOMMENDATION <br />Re-open the public hearing from February 16, 2016.
