I:\Commissions - NEW FOLDER\Planning Commission\2016\Working Docs\2016.05.17\Irondale Pressbox\SP2016-005, NC2016-002 (Irondale <br />High School) - RESOLUTION.doc 1 <br />RESOLUTION <br />PLANNING COMMISSION <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF A SPECIAL USE <br />PERMIT AND NONCONFORMING USE PERMIT. <br /> <br />WHEREAS, an application has been made by Larson Engineering on behalf of Independent School <br />District 621, to replace the existing stadium press box at Irondale High School located at 2425 <br />Long Lake Road. <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. Applications for a Special Use Permit and Nonconforming Use Permit were received on <br />April 28, 2016. <br />2. A public hearing notice was published in the May 4th edition of the New Brighton Bulletin. <br />3. Public hearing notices were mailed to property owners within 350’ on May 6, 2016. <br />4. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on May 17, 2016 and all present were given a chance to freely speak at the hearing. <br />5. The Planning Commission recommended approval on May 17, 2016. <br /> <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to the <br />Special Use Permit (SP2016-005) and Nonconforming Use Permit (NC2016-002): <br />1. The property is zoned R-1, Single Family Residential. <br />2. The property is guided in the Comprehensive Plan for Low Density Residential. <br />3. The property is legally described as follows: <br />Part of the NW ½ of Section 17, Township 30, Range 23, Ramsey County, <br />Minnesota. <br />4. The applicant has proposed to replace the existing 8’ x 42’ press box with a new 9’ x 54’ <br />press box. <br />5. The press box lies within the existing bleachers structure on the south side of the football <br />field. <br />6. The Planning Commission considered the proposal in accordance with Zoning Code Sections <br />4-030 which requires a Special Use Permit for schools in an R-1 zoning district. <br />7. The Planning Commission reviewed the proposal in accordance with the following Special <br />Use Permit conditions of Zoning Code Section 8-130: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />b. That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood.
