1
Janice Gundlach
From:Janice Gundlach
Sent:Tuesday, June 21, 2016 8:13 AM
To:'Sorensen, Jenifer (DNR)'
Cc:Craig Schlichting; Molly Patterson-Lundgren (mollypl@wsbeng.com); 'Sonsalla, Sarah J.'
Subject:RE: DNR Letter for City Shoreland Ordinance Conditional Approval
Attachments:Draft Shoreland Ordinance (4-11-2016).pdf
This is great Jennifer, thanks so much! Also, I just checked and our latest draft ordinance already includes the language
you ask for in your below email. Proposed Section 12‐320 (see attached draft) includes DNR notifications for “planned
developments” because we have two different types: 1) Planned Unit Developments and 2) Planned Residential
Developments. The intent with the phrase “planned developments” is it includes both. I hope this is sufficient.

My intent is to have the Planning Commission make their formal recommendation to the City Council on July 19th, with
the City Council taking final action on July 26th. At tonight’s Planning Commission meeting I will share your email. This
meeting schedule for ordinance adoption assumes we receive the letter you mention before July 19th and you are ok
with the language above regarding DNR notification for “planned developments”.

Again, thanks for much for your work on this. It will be nice to get this item wrapped up. I’ll let you know once we’ve
formally adopted our ordinance. Thanks again!

Janice Gundlach
Assistant Director of Community Assets
& Development/Planning Director
City of New Brighton
803 Old Highway 8 NW
New Brighton, MN 55112

Direct: 651‐638‐2059
Email: Janice.Gundlach@NewBrightonMN.gov
City’s Website: www.newbrightonmn.gov

From: Sorensen, Jenifer (DNR) [mailto:jenifer.sorensen@state.mn.us]
Sent: Tuesday, June 21, 2016 7:12 AM
To: Janice Gundlach
Subject: DNR Letter for City Shoreland Ordinance Conditional Approval

Janice –

I’ve prepared a letter of conditional approval for the City of New Brighton’s draft shoreland ordinance. I have submitted
it to DNR’s Central Region Manager, Terri Yearwood – she will be the person who will review and sign the letter that will
be sent to the City. Hopefully we’ll get you a copy of the letter by email today.

Just to let you know what’s in the letter (in case you don’t receive a signed copy today), the letter approves flexibility for
percent impervious and for the OHWL/SIZ setbacks for Jones and Poplar Lakes.

There is one section of the City’s draft shoreland regulations will need to be amended in order to grant final approval of
the City’s draft shoreland ordinance. In Section 12‐320, DNR Notification Procedures, you will need to include language
stating that preliminary plans for Planned Unit Developments (PUDs) will be reviewed and approved by MNDNR before
