<br /> <br />4 <br /> <br />Commissioner McPherson inquired if the front entry would be offset from the home. Mike Raymond, 74 16th <br />Avenue SW, explained with the addition to the home, the entry was now offset. It was noted the door would be <br />centered under the new covered entry. <br /> <br /> <br />Motion by Commissioner Danger, seconded by Commissioner Miwa to close the Public Hearing. <br /> <br />Approved 7-0. <br /> <br /> <br />Motion by Commissioner McPherson, seconded by Commissioner Danger, to approve staff <br />recommendation. <br /> <br />Approved 7-0. <br /> <br />(C) Heidi Haagenson & Cassie Schlangen request consideration of a Nonconforming Use Permit to <br />allow construction of a 2nd story addition above the existing home where the existing front and <br />side yard setbacks are less than required by code at 627 4th AVE NW. <br /> <br />Planning Director Janice Gundlach reported the applicant is requesting a Nonconforming Use Permit to allow a <br />second story addition to the existing home, which maintains an 18' setback to the front lot line when 30' is <br />required and maintains an approximate 2’ setback along the side property line when 5’ is required. Additional <br />nonconformities exist where the detached garage is setback 1' from the northern side lot line and about 4’ from <br />the rear lot line when 5' required, however no improvements are proposed to this structure. The existing <br />nonconformities will not be increased because the proposed addition will not enlarge the home’s building <br />footprint. Zoning Code Section 8-460 requires review and approval of a Nonconforming Use Permit to <br />determine if nonconformities can be reduced and/or eliminated where practical. It is not uncommon for a single <br />family lot in this geographic area of New Brighton to contain several nonconformities. This area is one of the <br />earliest developed, prior to adoption of the first Zoning Code, with the applicant’s home building built in 1922. <br />It’s important to note the Building Official believes the existing home’s foundation is structurally sufficient to <br />support the second story. Staff recommends approval of the request as submitted, subject to the following <br />condition: <br /> <br />1. The second story is constructed consistent with the plans provided and attached to the Planning Report <br />dated 7-19-2016. <br />2. It is recommended the applicant resolve the existing surface encroachments of the concrete patio and <br />wood privacy fence by eliminating them and/or obtaining an easement from the property owner to the <br />north. <br /> <br />Commissioner Deick asked if privacy fence and concrete pad encroaching onto the neighbor’s property had <br />been an issue in the past. Heidi Haagenson, 627 4th Avenue NW, stated this has not been an issue with the <br />neighbors in the past. <br /> <br /> <br />Motion by Commissioner McPherson, seconded by Commissioner Deick to close the Public Hearing. <br /> <br />Approved 7-0. <br />
