August 8, 2016 Page 1 of Of COUNCIL PROCEEDINGS the city that works fur you THE CITY OF NEW BRIGHTON Pursuant to notice thereof, a regular meeting of the New Brighton City Council was held Tuesday August 8, 2016 at 6:30 pm in the New Brighton Council Chambers. Present: Mayor Johnson, Councilmembers Burg, Jacobsen and Strub Absent: Councilmember Bauman Also Present: Dean Lotter -City Manager, Sarah Sonsalla-City Attorney Call to Order Call to order Mayor Johnson called the meeting to order at 6:30 pm. Pledge of Allegiance Pledge of Allegiance Mayor Johnson led the Council in the Pledge of Allegiance. Public Comment Forum Public Comment Forum Mayor Johnson opened the Public Forum for comments from the public. Susan Erickson, 2012 291h Avenue NW, discussed a petition and lawsuit that was being put together regarding Ordinance 829 against the City of New Brighton. She noted her attorney had contacted the City Attorney and explained a suit would be brought due to the fact the City illegally adopted Ordinance 829, and illegally rejected her previously submitted petition. She stated the City Attorney informed her attorney that the City Council would not be meeting for weeks and discussed the timeliness of this matter. She understood the City would begin printing ballots soon in violation of the law. She requested the Council address Ordinance 829, noting this Ordinance was to have been adopted no later than June 1St. She noted the ballot question petition was submitted in a timely manner and was valid. She reported Minnesota Court of Appeals has previously ruled on identical facts that the City Clerk's treatment of the petition was illegal. As a result, the petitioners have been forced to bring suit given the fact the City was not following the law. A settlement has been brought to the City Attorney with a deadline of today. There was no desire to file the suit, but the suit would be filed if the Council does not rescind Ordinance 829 and the ballot question was added.
