City of New Brighton represents 100 percent ofthe property owners involved to vacate the <br />described right-of-way. <br />2. That the City Council, pursuant to published notices, held a public hearing on the vacation, and all <br />persons present at the hearing were given an opportunity to be heard. <br /> <br />NOW, TIlEREFORE BE IT RESOLVED TIlE CITY COUNCIL OF TIlE CITY OF NEW BRIGHTON makes the <br />following Findings of Fact in respect to the proposed vacation: <br /> <br />1. The street right-of-way to be vacated is not improved, no longer serves a public purpose, and is <br />impeding the development ofthe Brighton Corporate Park II area. <br /> <br />BE IT FURTIlER RESOLVED, the Council hereby vacates that portion of the Second Street NW right-of- <br />way legally described as follows: <br /> <br />That part of Second Street NW, in the Southeast Quarter of the Southeast Quarter of Section 29, <br />Township 30, Range 23, originally acquired by Document No. 734462, which lies west ofthe west <br />line of Brighton Corporate Park, according to the recorded plat thereof, and south of a line, parallel <br />with and distant 60.00 feet south from the south line of Lot 4, Block 1, said Brighton Corporate <br />Park. <br /> <br />Adopted this 23rd day of July, 1996. <br /> <br />ATTEST: <br /> <br />~~/9:kd <br /> <br />Robert Benke, ~ayor <br /> <br />M~ <br /> <br />Finance Director/City Clerk <br /> <br />t:lJKO~ <br />M hew S.
